Rule 591-1-1-.15(9) requires that a written statement be on file from a medical authority when a child requires a modified diet for medical reasons and from the child's Parent(s) when a child requires a modified diet for religious reasons. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an investigation, it was determined that on February 28, 2024, a three-year-old child with a need for a modified diet on file in the 3A Classroom (Third Right) due to an allergy, was given a food that the child was allergic to for lunch on this date. The center was made aware of the child’s allergy during the child’s enrollment tour on February 26, 2024, however the center failed to obtain written documentation from a medical authority as required after the parent notified the center of the need for a modified diet. Additionally, the center did not notify all personnel when the staff members serving the child were not made aware that the child required a modified diet. As a result, the child experienced an allergic reaction and professional medical attention was obtained.
