Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devi ces to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

During a Complaint Closure conducted on February 9, 2024; It was determined based upon investigative findings that Center Staff restrained a seven-year-old child for three minutes. It was further determined that Center Staff restricted a seven-year- old child from using the restroom after the child verbally indicated that they needed to use the restroom a total of fourteen times.

Rule 591-1-1-.20(4) requires the Center to keep medication in a cabinet or container that is locked or otherwise not accessible to the children and to be stored separate from cleaning chemicals, supplies or poisons. Medications requiring refrigeration shall be placed in a leak-proof container in a refrigerator that is not accessible to the children.

During a Monitoring Visit conducted on August 10, 2022 ; It was determined based upon observation that a bottle of Infants Tylenol and a bottle of Little Remedies Gas Relief Drops were on a low shelf in an unlocked cabinet accessible to children in Classroom D.

During a Licensing Study conducted on February 22, 2022 ; It was determined based upon observation that the following hazards were observed accessible to children: Building Three Front Classroom ‡Fresh New Day Fresh Waters Spray was on a table on the middle left side of the classroom Classroom B ‡Huggies Simply, Huggies Natural Care Baby wipes, and Parent¶s Choice Natural Care Baby wipes were in children's cubbies Classroom A ‡A plastic grocery bag was in a child¶s cubby ‡A Staff purse was in an unlocked cabinet Classroom E: ‡An unlocked Electrical closet, was accessible on this date. ‡A pack of Gentle Steps Baby wipes, Fisher Price Baby wipes, Parents Choice Baby wipes, and a grocery bag were in an unlocked cabinet.

Rule 591-1-1-.36(4)(b) requires that the interior of a transportation vehicle be clean, in safe repair and free of hazardous items, objects and/or other non-essential items which could cause injury.

During a Monitoring Visit conducted on August 10, 2022 ; It was determined based upon observation that the vehicle used for transportation, Tag# QFA3060, had torn seats on the middle seat and right side of the first row, in the middle seat of the second row, on the right side of the seat on the third row, and on the front right corner of the seat on the fourth row. It was further determined that the vehicle used for transportation, Tag# RPC3167, had one torn arm rest on the right side of the first row, a tear on the back of the head rest of the first row, two torn arm rests on the second row and third row.
