On May 19, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding failing to follow regulations for outdoor play and failing to follow the termination policy. The incident had been previously discussed with OCCL staff on May 19, 2026, through phone calls and emails. An investigation began on May 19, 2026, and concluded on May 26, 2026. Based on interviews and a review of documentation, there is no evidence to substantiate this complaint for failing to follow regulations for outdoor play. Provider #1 stated they provided the children with water to drink, shade, and water play, including a wading pool. Weather documentation reviewed showed while there was a code orange air quality alert issued for May 19 20, 2026, the actual air quality was in the moderate code yellow range on those dates. While a heat advisory was also issued, the recorded temperature exceeded 89 degrees only for a short period of time in the afternoon. The provider was reminded to be aware of and follow all guidance regarding air quality or heat advisory alerts. Based on interviews and review of documentation, there is no evidence to substantiate this complaint for failing to follow the termination policy. Provider #1 provided documentation of a written text, rescinding their decision to terminate care for Child #1.

On September 5, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding not providing water to a child, keeping a child in restraining equipment for extended period of time, not meeting a child's needs, and disrespectful communication with a parent. An investigation was conducted on September 10, 2024. Based on interviews conducted, this complaint is substantiated for disrespectful communication with a parent. Although Staff #1 stated Parent #1 was disrespectful to Staff #1 and Staff #2, Staff #1 stated they did use disrespectful language with Parent #1. Based on a follow-up phone interview with Staff #1, this complaint is substantiated for not completing an injury report for Child #1. Although Staff #2 had a conversation with Parent #2 about the injury to Child #1, there was no written documentation. Based on observations and interviews with staff, there is no evidence to substantiate this complaint for not providing water to Child #1. Staff #1 and Staff #2 both stated water is readily available to all children throughout the day. Staff #2 stated Child #1 had access to their cup and was observed picking up the cup during the day. When Staff #2 realized Child #1 was not getting water out of their cup, they provided Child #1 with a different cup. Based on interviews and documentation of text messages between Parent #2, Parent #1 and Staff #2, there is no evidence to substantiate this complaint for keeping a child restrained for an extended time. Staff #2 stated they placed Child #1 in the pack and play for ten to fifteen minutes at a time. Based on interviews and documentation, there is no evidence to substantiate this complaint for not meeting the needs of a child. Staff #2 stated they communicated with the Reporter and Parent #1 through text messages and in-person communication at pick up time about Child#1 s transition into the program.
