An investigation was conducted on August 28, 2024. The complaint is substantiated for not following the facility's health exclusion policy because two children were excluded from care for coughing and a runny nose with no fever. The exclusion policy states the cough must be persistent and other symptoms, including a fever of 101 degrees Fahrenheit or greater. Furthermore, there are no additional addendums or updates to the parent handbook with a change in facility policy. There is no evidence to substantiate the allegation of food not being prepared on-site because lunch was being prepared during the visit. There is no evidence to substantiate the allegation of a menu not being posted because the current month's menu was posted in the entryway. There is no evidence to substantiate the allegation of the facility not being clean because the floors and flat surfaces were observed to be clean and in good repair. An additional concern noted was the four-year-old classroom needed a labeled disinfecting solution bottle.

Floors, walls, counter surfaces, toilets, and surfaces or finishes must be cleanable and in good repair. The infant classroom ceiling is deteriorating; the trash can contains waste without a liner. The yellow classroom, the wall by the door is moldy under the air conditioner all the way to the floor, the ceiling is peeling, the molding and sills are peeling paint, where the floor strip is, there is a soft spot in the room floor, and there are holes in the closet wall. It was observed a toilet seat in each bathroom was not cleaned after use, because soap and water and disinfectant labeled bottles are not available. Toys and classroom materials in each classroom need to be cleaned and disinfected it was observed that there were dusty items, dead bugs, and dirt in the bottom of the bin storing the toys, on surfaces, and dirty toys in each classroom.

The exit to the playground in the preschool classroom was obstructed with a pole between the door and the push handle preventing it from opening. Clean the walls and toys in the school-age classroom. The Office of Child Care Licensing (OCCL) received a complaint on June 30, 2023, regarding lack of supervision and failure to follow accident and injury reporting procedures. An investigation was conducted on July 5, 2023. This complaint is substantiated for a lack of supervision because children had scissors and were able to cut a shirt multiple times and a doll s hair without the staff knowledge or intervention. According to the attendance records for June 29, 2023, children were not left alone in the classroom. There is no evidence to substantiate the allegation of improper accident and injury reporting because the interviewed staff provided information about accident and injury procedures which align with the DELACARE Regulations.

On May 4, 2023, a complaint was called into the Child Abuse and Neglect Report Line and not accepted for investigation by the Institutional Abuse Unit (IAU). The Office of Child Care Licensing (OCCL) accepted the complaint for investigation on May 5, 2023, regarding staff not following requirements for positive behavior supports, diapering, and meals and snacks. An investigation was conducted on May 11, 2023. There is no evidence to substantiate the reported allegations. The staff interviewed stated no staff have ever hit or threatened to hit any child in care at the facility. The administrator also denied threatening or hitting her own children while at the facility. A staff member said one child in the three-year-old classroom wears a diaper. The staff member reported the child is potty training and uses the bathroom every two hours or less, so their diaper rarely needs to be changed. Regarding meals and snacks, the licensing specialist observed children eating lunch, and the serving sizes were more than the required minimum for each food item. Concerns noted were not enough staff were physically present to fulfill the minimum daily functions and proper staff-to-child ratios were not maintained. A staff member left another staff member alone in the toddler classroom with seven children, ages one and two, to answer the main door and clean the kitchen.

OCCL received a complaint on May 13, 2022. On May 23, 2022, IA informed OCCL they would not be investigating the reported allegation. An investigation was conducted by OCCL on May 24, 2022, regarding improper discipline and possibly not providing an accident/ injury report. This complaint is no evidence to substantiate because all staff interviewed denied the allegation of improper discipline and stated Child #1 s injury did not occur while in the facility.

OCCL received a complaint on January 24, 2022. An investigation was conducted on January 25, 2022 regarding lack of supervision and improper staff-to-child ratio. This complaint is substantiated because LS Sommer observed Staff #2, an intern without fingerprinting and criminal history eligibility, alone with four preschool-age children. Additionally, according to attendance documentation from January 21, 2022, showed Staff #2 was alone from 3:30 p.m. until 5:36 p.m. with eight school-age children before Staff #1 arrived. Additional concerns noted were an infant was observed asleep on the boppy pillow, and a staff file was not available and was not provided for Staff #2 during the annual full compliance review in December.
