On October 4, 2023, a one-year-old child was left on the outside play area unattended for approximately 20 minutes. Staff were unaware the child was outside until a parent arrived to pick up the child and the child could not be found in the center. Staff #5 found the child outside in the play area. The child was by the door that leads to the infant classroom. The child was crying when she was located. When the child was left alone, Staff #3 and Staff #6 were signed into attendance records as responsible for the child. Staff #3 is an intern, but had not been employed for at least 30 days, and was not determined eligible through a comprehensive background check. Staff #6 is under 18. Both staff could not be alone with children. According to attendance records on October 4, 2023, Staff #1, an aide without criminal history determination, and Staff #2, an aide, were alone with eight infants from 8:45 am to 1:30 pm. and 2:30 p.m. to 3:30 p.m. in the infant classroom. In the Preschool classroom, Staff #3 was alone from 1:00 p.m. to 2:00 p.m. during naptime with seven preschool age children. During the visit on October 6, 2023, Staff #2 and Staff #3 were alone in the infant classroom with seven infants. Attendance records showed Staff #2 and Staff #3 were alone in the classroom from 8:15 a.m. until 9:20 a.m. when the licensing specialist had Administrator Cannon enter the classroom. The complaint was substantiated for lack of supervision because on October 4, 2023, a one-year-old child was left on the outside play area unattended for approximately 20 minutes. Staff were unaware the child was outside until a parent arrived to pick up the child and the child could not be found inside the center. A staff member found the child outside in the play area. The child was by the door that leads to the infant classroom. The child was crying when she was located. When the child was left alone, the staff members responsible for the child were not determined eligible and could not be alone with children. Concerns noted during the visit were two unqualified staff were alone in the infant classroom with seven infants, attendance records showed unqualified were alone in Infant and Preschool classrooms on October 4, 2023, and staff and child attendance records were incomplete.

The Office of Child Care and Licensing (OCCL) received a complaint on June 6, 2023, regarding improper staff-to-child ratio, improper discipline, not being truthful, and not following screen time requirements. An investigation was conducted on June 7, 2023. The complaint is substantiated for improper staff-to-child ratio because according to attendance records on May 30, 2023, the infant classroom had nine children present, the youngest was an infant, from 1:30 p.m. to 4:00 p.m. On June 5, 2023, an aide was alone with up to six children. On June 6, 2023, Ms. Cannon was alone with six infants from 8:20 a.m. to 8:25 a.m. There is no evidence to substantiate the allegations of improper discipline, not being truthful, and not following screen time requirements because all staff interviewed denied these allegations. Several additional concerns noted were the fence in the back of the outdoor play area is broken and splintering. The gate to enter and exit the outdoor play area is not self-closing. In the kitchen, the counters were not cleaned and were cluttered with dirty dishes, the floor was not cleaned of food particles, there was buildup of dirt and debris on the floor, and a trash can without a lid was observed. In the Toddler Two classroom, the classroom sink area had mold and mildew on the walls, baseboard, and carpet in the classroom sink area and dirty dishes were sitting on a classroom shelf. An infant daily log needed to be updated with an infant s sleep time. A plastic bag was accessible to toddlers. Infant bottles were not labeled with the infant s name. Child attendance was incomplete because several children were not signed out on May 30, 2023. Staff attendance was inaccurate and incomplete because on June 7, 2023, two parent volunteers were present, but were not signed in on the infant attendance record. On May 30, 2023, Staff #1 was signed into the both the combined a.m. classroom and the infant classroom from 8:00 a.m. to 9:00 a.m. O n June 5, 2023, Staff #1 was signed into both the infant classroom and the toddler classroom at the same time from 8:00 a.m. to 12:41 p.m. and 1:41 p.m. to 4:10 p.m. Staff #2 was signed into both the infant classroom and the toddler classroom at the same time from 11:50 a.m. to 12:40 p.m. and 1:30 p.m. to 3:30 p.m. Staff #3 was signed into both the infant classroom and the toddler classroom at the same time from 12:41 p.m. to 4:00 p.m. Staff files were incomplete.

According to Ms. Cannon's staff plan and verbally on the phone, a staff member determined prohibited and deactivated in the system by criminal history, was alone with five pre-school age children. Licensing Supervisor Vandewater reminded Ms. Cannon this staff was prohibited and informed her to terminate the employee immediately. This was corrected when Ms. Cannon agreed to comply.

Staff stated they call the administrator from another center to break them as needed, but sometimes it takes hours before she arrives. This was corrected when the administrator arrived at the center.

Toddlers must be cared for in an area separate from the older children. One classroom had seven children ages two-years to four-years-old.

The Office of Child Care Licensing (OCCL) received a complaint on July 6, 2023, regarding infant safe sleep violations and improper infant feeding. An investigation was conducted on July 7, 2023. This complaint is substantiated for non-compliance with infant safe sleep requirements because the specialist observed two infants asleep in bouncers and one infant asleep in a swing. There is no evidence to substantiate the allegation of improper infant feeding because during the visit an infant was observed being held while being fed a bottle and staff stated they hold the infants when they are fed. A concern noted was the facility did not have a qualified staff trained in day-to-day operations.

The Office of Child Care and Licensing received a complaint on May 1, 2023, regarding improper staff-to-child ratio, not understanding the child s needs, and not having water available. An investigation was conducted on May 4, 2023, and May 10, 2023. This complaint is substantiated for not understanding the child s needs because Staff #5 stated she gave Child #1, a one-year-old, a hot chip, which caused the child to cry and shake. This complaint is substantiated for improper staff-to-child ratio because Staff #5 stated she left the infant room to enter the Toddler 1 s classroom leaving five infants with one staff member. There is no evidence to substantiate the allegation of not having water available because Staff #2 and Staff #5 stated the child did receive water. Several additional serious concerns were noted. There were not enough staff physically present on May 4, 2023, to fulfill the minimum daily functions because all staff that were present were needed in the classrooms to maintain staff-to-child ratio. One infant was observed asleep in a bouncer and one infant was asleep in a swing. When the specialist informed the staff that the infants must sleep in cribs, one staff placed one infant on his stomach. The specialist informed the staff, the infant must be placed to sleep on his back. Attendance records from April 26, 2023, May 8, 2023, and May 9, 2023, documented several times unqualified staff, and staff under 18 were alone in the classroom with children; several times children were present in the classroom, but no staff were documented as present; Staff #8, who was not yet determined eligible through a comprehensive background check, was present in the classrooms on May 8, 2023, and May 9, 2023; and several times staff-to-child ratio was not maintained. Other concerns noted were the gate to the outdoor play area was not self-closing or self-latching, the last fire drill and inspection checklist was on March 10, 2023, staff were sharing food with children by giving a one-year-old a hot chip, and attendance records for both staff and children were not accurate and did not include exact arrival and departure times.

The Office of Child Care Licensing (OCCL) received complaints on February 17 and 21, 2023, regarding staff-to-child ratio. An investigation was conducted on February 21, 2023. This complaint is substantiated because according to attendance records from February 15, 16, and, 17, 2023, two classrooms were documented as not following proper staff-to-child ratio. Additional concerns noted were staff and children s attendance were incomplete because there were several staff and children not signed out.

The Office of Child Care Licensing (OCCL) received a complaint on January 23, 2023, regarding improper discipline, and lack of supervision. An investigation began on February 1, 2023, and concluded February 7, 2023. There is no evidence to substantiate this complaint for improper discipline or lack of supervision because staff denied an incident occurred at the facility which could cause a bruise on the two-month-old s cheek although the infant was in care from 8:40 a.m. until 1:00 p.m. The incident report provided to the parent describing what happened stated, teachers are not sure but baby didn t come with bruise . Several concerns were noted during the investigation. Infant safe sleep procedures were not followed because Ms. Cannon and Staff #2 stated Child #1 was placed in the swing to sleep on January 19, 2023, and on February 1, 2023, LS Sommer observed one infant asleep in the swing, and another infant asleep in the boppy pillow. The facility did not have enough staff to operate on February 1, 2023. On February 7, 2023, Staff #4 was present at the facility without a criminal history determination. Staff #4 was instructed to leave the facility because she could not be present without a criminal history eligibility determination, which left the facility with insufficient staff to provide bathroom breaks, lunches, and complete administrative duties. Staff attendance was inaccurate because according to attendance records from January 19, 2023, Ms. Cannon was documented as being present both in the infant classroom from 12:00 p.m. until 6:00 p.m. and the preschool classroom from 1:24 p.m. until 2:20 p.m. Documentation of health checks for all children could not be provided for each day the facility was in operation, including the date of the incident. The incident report signed by Parent #1 and Ms. Cannon was incomplete or missing the following required items: date the parent/guardian was notified, the method of notification, and the staff who notified the parent/guardian. There were several missing outlet covers throughout the facility, five prohibited air fresheners were observed and removed from various classrooms, and torn carpeting was observed in the preschool classroom.
Disposition: No Evidence to Substantiate with Concern
On April 22, 2022, OCCL received a complaint regarding not allowing a parent into the building, not following meal requirements and serving expired food, not having security procedures in place, and improper staff-to-child ratios. An investigation was conducted on April 28, 2022. This complaint is substantiated for not allowing parents in the building because Ms. Cannon and all staff interviewed stated parents are not permitted access to the classrooms. There is no evidence to substantiate for improper staff-to-child ratio, not following meal requirements and serving expired food, and not having security procedures because LS Sommer observed proper staff-to-child ratio, security procedures were in place, and all food observed was not expired.

OCCL received a complaint on March 4, 2022, regarding falsifying documentation. An investigation was conducted on March 15, 2022. There is no evidence to substantiate this complaint for falsifying documentation because all staff denied this allegation. Additional concerns noted include the following: lack of supervision because a room of napping children was left unattended so Ms. Cannon could answer the door, improper staff-to-child ratio because one staff was alone with five infants, and not having enough staff to operate because no one was available to answer the door, to cover bathroom breaks or lunch breaks for the two staff who were present, or to provide meals and snacks for children without leaving the classroom.
