OCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On March 27, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding staff touching a child inappropriately. This concern was previously self-reported to OCCL by the facility on March 26, 2025. An investigation was begun on April 24, 2025, and concluded on May 12, 2025. Based on staff interviews, written staff statements, a review of documents, and administrator interviews, there is no evidence to substantiate this complaint regarding staff touching a child inappropriately. Neither the administrator nor staff who were in the classroom observed any inappropriate touching of a child by other staff. An internal investigation was conducted by the facility at the time of the incident, however Staff #1 resigned her position on May 6, 2025, before the investigation could be concluded and an outcome determined.. An additional concern noted was that the parent was not notified by the center of important information relating to their child.

The administrator and all staff interviewed stated they did not see any injury to Child #1 on the date in question. There is no evidence to substantiate this complaint for not following their policy regarding handling complaints from parents or guardians because, based on interviews, the administrator called Parent #1 to discuss the concerns, left a voicemail message, but Parent #1 did not return the call. The administrator then sent an email to Parent #1 with an incident report, although it was not clear what caused Child #1 s eye to be red. The administrator also stated the center has leadership team members available daily and during the afternoon pick up times to discuss any parent concerns.

On March 14, 2024, a complaint was called into the Child Abuse and Neglect Report line and not accepted for investigation by the Institutional Abuse Unit (IAU). The Office of Child Care Licensing (OCCL) received the complaint on March 14, 2024, and accepted it for investigation regarding lack of supervision. State Police Youth Aid Division was also involved and conducted an investigation. An investigation by OCCL began on March 14, 2024, and concluded on May 21, 2024. On April 10, 2024, LS Sheehan was cleared by State Police Youth Aid Division to begin OCCL's investigation. On May 21, 2024, LS Sheehan received an email from Detective Harris at the State Police Youth Aid Division stating he has completed his investigation and has deemed the incident non-criminal in nature. Detective Harris stated based on the totality of the circumstances, this case has been closed. Based on information received from law enforcement, staff interviews, and classroom observations there is no evidence to substantiate this complaint for lack of supervision

On February 20, 2024, a complaint was called into the Child Abuse and Neglect Report Line and was accepted for investigation by the Institutional Abuse Unit (IAU) but was later abridged. It was sent to the Office of Child Care Licensing (OCCL) on February 21, 2024, and accepted for improper discipline and not following mandated reporting requirements. An investigation was conducted on February 27, 2024. Based on interviews conducted, this complaint is substantiated for failing to follow mandated reporting requirements and for improper discipline. In late 2022, Staff #1 observed and informed Administrator White about Staff #2 s concerning interactions with children, but no report was made to the Child Abuse and Neglect Report Line. However, based on an internal investigation, Ms. White placed Staff #2 on administrative leave, then terminated her employment on December 16, 2022. Staff #1 was required to re-take the Bright Horizons Mandated Reporting and Recognizing Abuse training.

The Office of Child Care Licensing (OCCL) received a complaint on November 30, 2023, regarding inappropriate positive behavior support. An investigation was conducted on December 13, 2023. Based on interviews conducted and documentation reviewed, there is no evidence to substantiate this complaint. Staff #2 provided an activity that was initiated by Child #1 s interest. When two children began to display inappropriate behavior, Staff #1 moved the other children in the room away from the behavior and called for help. When Child #3 was accidentally hit on the head by a Unifix block, Staff #1 checked to see that the child was okay and did not see any mark on the child. Child #1 and Child #2 were removed from the room by another staff member and helped to calm down.

The Office of Child Care Licensing (OCCL) received a complaint on November 20, 2023, regarding lack of supervision and improper discipline. An investigation started on November 28, 2023, and ended on November 30, 2023. Based on interviews conducted this complaint is substantiated for improper discipline. Although the licensing specialist observed appropriate voice levels and positive redirection at the time of the visit, three staff interviewed confirmed Staff #5 does yell at the children. Based on interviews conducted, there is no evidence to substantiate this complaint for lack of supervision. The specialist observed staff supervising children appropriately while engaging children at eye level, changing a diaper, and extending language development through play. The administrator stated she has no concerns regarding staff supervision of children.

Based on the results of this investigation, this complaint is substantiated for improper discipline because staff interviewed stated Staff #2 was observed using a loud tone with children and grabbed a child by their shirt., resulting in no marks or injury. The center acted quickly by placing Staff #2 on administrative leave on October 25, 2023, the day of the incident. After an internal investigation Staff #2 was terminated from employment on November 2, 2023, for failure to interact appropriately with children. Staff interactions were observed to be age appropriate and friendly at the time of the investigation.

The Office of Child Care Licensing (OCCL) received a complaint on September 14, 2023, regarding lack of supervision, failing to notify a parent of a significant incident, and staff-to-child ratios. Based on interviews with the administrator and multiple staff, as well as review of documentation there is no evidence to substantiate this complaint. Attendance records and observations at the visit showed classrooms were in correct staff-to-child ratio. Staff were observed to be supervising children appropriately.
