101216.3(a) Teacher-Child Ratio There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance... This has not been met as evidenced by Director states facility moved teachers around to have a five minute cushion so they can be available if needed. Director states the assistant Director or Director step in if needed. Director states she is in the process of hiring another teacher that will start 1/8/23. Director states the facility will send the department a written statement of the understanding of this regulation, updated LIC500, and a plan of correction by 12/13/23. Based on Directors own admission, interviews conducted and records reviewed, the facillity did not comply with the section cited above by having one teacher supervising more than 12 children from 10/23/23 to 11/8/23, which poses an immediate Health, Safety, and Personal Rights risk to persons in care.

(f) ... arrangements shall be made for a fully qualified teacher....to act as substitute...shall be aware of center operations...designated as an authorized person to correct operational deficiencies... This requriement was not met as evidenced by Director states some teachers are fully qualified but did not designate a teacher to fill in as the substitue Director. Director states she will talk with the staff that can be designated to be the substitute Director, if needed. Director states she will call them to let them know if they need to be designated. LPA arrived at the facility at 7:45 AM and the Director was not on the premises at the time of this inspection. LPA asked for the substitute Director and LPA was advised the substitute Director was not available as well. Staff did not know who was in charge. Director arrived on or about 8:30 AM. Director stated she conduct a montly check of the medication box to ensure medication is not expired. Director stated she will set a montly reminder on Outlook. Based on LPAs observation and director's admission facility staff did not maintain medication per the label's instructions. This poses a potential health and safety risk to children in care.
