101223(a)(3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

Director stated that the Rhino Room will be reopened and would return to classroom use beginning 8/15/2024. In the meantime, a door knob with a lock would be installed so the Rhino Room is inacessible from the restroom. Director will provide proof of corrections via emai to LPA. Based on interviews and observations, Staff 6 was punishing children by putting them in the restroom and/or the room where the napping equipment is kept also known as the Rhino Room that is accessible from a second door inside of the restroom then turning the lights off and shutting the door leaving children in the room by themselves which poses an immediate risk to the health and safety of children in care.

See LIC9099-D for deficiencies. Upon receipt, the Director shall post the Notice of Site Visit and the Licensing report. This report and the Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next twelve (12) months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Director with a blank copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report. Based on the information obtained through observations and interviews, the allegation is substantiated. A substantiated finding means that the complaint is substantiated and the allegation is valid because the preponderance of the evidence standard has been met. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director, Kimberly Ogas.

101212(d)(1)(D)Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (D) Any suspected physical or psychological abuse of any child.

101223(a)(1)Personal Rights -To be accorded dignity in his/her personal relationships with staff and other persons. Plan of Correction - The director will submit a plan of correction to clear the violation by 9/7/23. The director will have an In-Service Training meeting within two weeks with the staff regarding personal rights and the process for handling children with behavior issues. This is evidenced by: The investigation revealed that Child #1 has been pulling other children's hair and other inappropriate behaviors that violate children's perrsonal rights. This is an immediate risk to the health and safety of children in care.
