101170 Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department or (2)Request a transfer of a criminal record clearance as specified in Section 101170(f) or (3) Request and be approved for a transfer of a criminal record exemption, as specified in Section 101170.1(r), unless, upon request for a transfer, the Department permits the individual to be employed, reside or be present at the facility.
This requirement is not met as evidenced by: Deficient Practice Statement All 8 employees working at the center did not have associations to license. 2 out of 8 need Exemption Transfer or new Live Scan. Rest of the 6 have working clearances or were associated to another licensed childcare facility. This posed a potential risk to safety of children. Civil penalty of $800 assessed ($100 per person for 1 day). POC Due Date: 12/14/2023
