Chapter 4 Section 2 · Chapter 4. General Requirements Section 2. Capacity/Supervision Requirements. (a) The licenser shall determine total capacity for each facility. The licensed capacity shall never be exceeded. Maximum group size shall be limited by facility capacity. For specific rules relating to Capacity and Supervision refer to Chapters 5, 6, and 7.

Chapter 4 Section 3 · Chapter 4. General Requirements Section 3. Owner, Director, and Staff Requirements. (f) All staff, household members, substitutes, and volunteers shall complete a full fingerprint based national criminal history record background check and a state criminal registry check for Wyoming and for each state the person has lived in the past five (5) years, every five (5) years. These checks shall be kept current at all times, using the date the check was performed as the initial date, and repeated every five (5) years thereafter. The Department may require a new full fingerprint based national criminal history record background check or a state criminal registry check for Wyoming and/or each state the person has lived in the past five (5) years at any time for staff, household members, substitutes, and volunteers.

Chapter 4 Section 14 · Chapter 4. General Requirements Section 14. Health and Safety Requirements. (t) Staff and household members shall not consume or be under the influence of any substance that may impair their ability to care for children, including, alcohol, certain prescription drugs or illegal drugs; or misuse prescription drugs or over-the-counter drugs, on or off the premises, while child care children are present, and while transporting child care children. The use of tobacco, tobacco products or electronic cigarettes is prohibited in the facility or off premises when children are present and in care.
