10.9 · Emergency evacuations shall be practiced with the children each month. A record of practice drills for the previous and current year shall be maintained and available onsite. Practice drills may be pre-announced. There shall be: * a system in place to assure that all children are accounted for at a predetermined safe place; * a safety plan that may include additional lock down practices and procedures.
Upon review of the program's evacuation drill log it was identified that no drill had been conducted in the month of March 2026.

11.20 · There shall be a conveniently located toilet and hand washing sink for every fifteen children or portion thereof. Toilets are to be used only by children, parents, Staff and volunteers of the center during program hours.
The program has access to only one of the approved toilet and hand sinks. The program's arrangement with a co-tenant in the building had allowed for access to two toilets and sinks within that tenants space. During this visit, it was confirmed that the program has not had access to those toilets and sinks since January 2025.

13.18 · Written parental permission shall be obtained before administering any medication. The permission statement shall include the name of the child, name of the medication, dosage, the date and time to be given and how the medication is to be given (mouth, ear, etc.).

6.2 · The maximum number of children in an identified group shall be twenty six (26).
From 3:05 p.m. to 4:31 p.m., the program was out of compliance with group size. During this time, the number of children ranged from thirty-two (32) to twenty-seven (27). Children and staff remained in the table area and grass space adjacent to the table area. Staff confirmed that the program operates as one large group with children moving from eating, art, and/or gross motor as they chose. Staff statements confirm that staff are not assigned to certain activities and/or smaller groupings of children and that children are not identified as part of smaller sub groups. This is a serious violation of group size .

13.20 · All prescription medications shall be kept in the original containers and be clearly labeled with children's name, dosage, medication name, and schedule of administration.
Two children's emergency medications do not have labels upon the medication nor information about appropriate dosage. One medication is stored in a plastic bag with the child's name handwritten on the bag and the other is stored in an case with only the child's name written on the case.

5.34 · The Program Administrator and the Site Director shall annually complete at least a minimum of twelve clock hours of Professional Development Activities which may be applied toward their Individual Professional Development Plan (IPDP) or equivalent excluding any additionally required training for Specialized Child Care or First Aid and CPR.
Review of BFIS account as well as staff files on site, in addition to on site coversation with Staff A confirms, Staff A did not complete any of the Professional Development hours required by this rule. The period reviewed for Staff A for the this visit was 8/10/22 thru 8/10/23.
