5.4.2.3 · The FCCP and staff shall ensure that infants sleep in cribs or port-a-cribs. 6.2.2.4 · The licensed FCCP shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
Upon arrival at the program it was observed that there were only two (2) staff members present with twelve (12) children. The third staff member arrived eleven (11) minutes after the licensors arrived. When discussed with the provider she stated the staff member had left at 10:00am for an appointment and their substitute wasn't available that day. The program was out of compliance for approximately one hour and twenty-three minutes. When there are twelve (12) children present at the program the regulation requires three (3) staff to be present. This is a serious violation.

3.6.1.1 · The FCCP shall develop and maintain a written Emergency Response Plan to respond to a full range of emergencies both natural and man-made.
