5.4.1.5 · Children shall be supervised by FCCP and/or staff while napping or resting. The FCCP and/or staff shall directly observe a sleeping child at least every fifteen (15) minutes to check the child's face, view the color of the child's skin, and check on the child's breathing.
Upon arrival at the program at approximately 9:00 AM, the provider was caring for five children in the living room area. When asked, the provider stated that there was an infant sleeping in one of the bedrooms. While the provided stated that she had performed an in person check on the child just before Licensor Knight's arrival, the provider was not observed to perform any direct observations of the resting infant during the viist. After approximately one hour, Licensor Knight entered the bedroom to find the infant awake in a pack and play with a bottle of milk or formula, a video controller and a set of headphones with a cord which measured at least two feet.

5.10.1.1.2 · The FCCP shall ensure that children are protected from choking hazards presented by cords on window coverings, electric or electronic appliances or equipment and telephone cords.
Approximately an hour after arriving at the program, Licensor Knight observed the rooms where children sleep. One infant, was awake in a pack and play in one of the rooms. There was a pair of headphones with a cord that was at least two (2) feet long in the pack and play with the infant.

2.3.8.3 · The FCCP shall ensure that the FCCP; all individuals residing in the home; staff; and any individuals who are left alone with children have met ongoing background check requirements by submitting at least once every five (5) years a Records Check Authorization form to the Division and as required shall submit to fingerprinting.
A review of staff and family member's BFIS accounts, reflected that the provider was due for five (5) year fingerprinting in July 2023 and that Individual A, who resides in the home, was made aware of their need to submit to fingerprinting on 03/26/2021. Neither the provider or the individual had completed this process as of the date of this visit.

7.1.2.2 · The FCCP shall ensure that at least one (1) responsible adult who has successfully completed and is currently certified in pediatric first aid and infant and child CPR is on the premises at all times children are present.
A review of staff BFIS Quality and Credential accounts and available docuemnts on site reflected that the provider and Subsitute A had not renewed their pediatric first aid and infant and child CPR certifications prior to expiry and were not currently certified. The provider confirmed that neither the provider or Substitute A were currently certified in pediatric first aid and infant and child CPR. The provider was the only adult present with the children during this visit. The provider confirmed that Substitute A has continued to actively substitute at the program.

3.3.7.3 · Within six (6) months of initial date of employment, the FCCP and all staff shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications, and all annual professional development activities as specified in the rules sections 7.3 and 7.4 of these regulations shall be submitted to NLCDC to be verified and maintained in BFIS.
A review of the program's BFIS account reflected a lack of the following documentation: High School diplomas for the provider and substitute, mandated reporter training certificate for the provider and up to date CPR and First Aid ceritifcates for the provider and substitute.
