3.2.5 · Self-reported violations: If an incident or situation occurs in a CBCCPP while children are present that could be considered a serious violation as defined in the rule 2.2.50 of these regulations, the licensee has a responsibility to self-report this to the Division within twenty-four (24) hours of the incident. A complete report will include a description of the incident, what the licensee has done to verify the particulars of what occurred, and how the licensee has taken corrective action to ensure the safety and well-being of children and to prevent a future serious violation. If such a report is received in a timely manner from a licensee with a history of consistent regulatory compliance, no child has been seriously injured or harmed as a result of the incident or situation, and the licensee has taken prompt and appropriate corrective action; the Division may, on a case by case basis and at the Division's discretion, elect to issue a warning, rather than a violation related to that incident or situation.
On 04/16/2026 Staff A roughly handled and aggressively yelled at Child A. This incident was not reported to the Child Development Division as required. The incident was discovered on 04/27/2026, eleven (11) days after the incident, when this licensor asked about currently employed staff as part of the yearly regulatory compliance visit on 04/27/2026.

6.2.5.2 · Staff shall appropriately hold, touch, smile and talk to children.
Five (5) staff members reported to management that they observed Staff X interact inappropriately with two (2) and a half year old Child A on 04/16/2026. Staff reported that Staff X became frustrated when Child A kicked a toy. In response Staff X abruptly grabbed Child A by the arms and moved them away from the toys. During this interaction Staff X was reportedly screaming at Child A in an aggressive manner. Staff stated that Staff X appeared extremely angry during the incident and after the incident stated they needed to leave and take a break. During staff interviews information indicated that Staff X required frequent breaks to walk away when a child was crying or exhibiting a challenging behavior. Information also indicates that at least one (1) staff member shared concerns about Staff X's ability to handle frustration and their need for frequent breaks prior to the 04/16/2026 incident. It does not appear there was follow up to these concerns, the director stated they had not conducted any formal observations of Staff X in the classroom after they were hired. Staff X was placed on administrative leave after the incident and was then terminated. This is a serious violation.

6.2.7.4.3 · No form of inappropriate discipline or corporal punishment shall be used with children such as but not limited to: Withholding of food, water, or toilet use;
Staff Y reported that Staff X did not allow Child A to use the bathroom, Staff Y had to intervene and take the child to the bathroom. Staff Y reported that Staff X was frustrated that Child A was fooling around and using the wrong end of their fork to pick up chicken nuggets. In response; Staff X pulled the fork from Child A's mouth mid bite and removed Child A's plate from the table, Staff X eventually gave the plate back to Child A and they were allowed to finish their lunch. Staff X was terminated from their position. This is a serious violation.

6.2.4.3 · The program director shall ensure that each group of children is led by a staff member who is at least qualified as a teacher associate for at least 75% of the hours of operation.
The program is required to provide this licensor with a hiring update every three(3) weeks. Please submit a detailed plan of how the current staff members will be supported until a qualified teacher associate is hired. The plan will identify how often the director will conduct observations in the classroom, how they will mentor current staff and how they will ensure that they enter a variance within thitry (30) days after a teacher associate is no longer leading a group.

3.7.2.2 · The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes. Licensees of a CBCCPP located within a public or independent school building may count a lock-down drill performed while the CBCCPP is in operation in place of a monthly evacuation drill with the CBCCPP children and staff and at least three (3) of the monthly drills conducted within 365 days shall be evacuation drills.
Between April of 20205 and April of 2026 the program conducted four emergency evacuations. The program is required to conduct a month evacuation and did not. It should be noted that evacuations have occured monthly since the new director took over in December of 2025.

6.2.6.6 · The program director shall ensure that no person be left alone with children without approval from the Division based on the results of a background check that includes fingerprinting; with the exception of a parent may be left alone with his/her own child(ren).
Staff A's fingerprint clearance letter was issued on 04/09/2026, Staff A was listed on the staff schedule as working alone in the Preschool classroom in March of 2026, prior to the program receiving the letter clearing them to be alone with children.

3.4.7.3 · Within six (6) months of the initial date of employment; staff and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations, and the program director shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications, and all annual professional development activities as specified in the rules in sections 7.3 and 7.4 of these regulations shall be submitted to Northern Lights at CCV to be verified and maintained in BFIS.
Staff BFIS Quality and Credential accounts are not up to date and are missing required training and educational documentation. This was noted as a talking point on last years regulatory compliance visit report, the talking point required the program to submit missing documentation to Northern Lights at CCV, however documents were not submitted. The current director stated they recently realized the former director was not submitting documents and prior to this visit submitted documents to Northern Lights at CCV.

7.2.2 · The licensee shall ensure that all new staff and auxiliary staff, prior to working with children in the CBCCPP; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.
Staff B was working with children the day of the visit, the program had not sent a record check authorization form to the Child Development Division and therefore licensing had not cleared them to work at the program. Staff B was previously employed by the program several months ago and had just returned. We have since processed the record check and confirmed they must complete background check documentation and complete fingeprinting.

6.2.4.4 · The program director shall ensure that a staff member who is at least qualified as a teacher assistant is present while children are present at the CBCCPP.
The staff schedule was reviewed and indicated that there where days in which the program operated without a staff person on site that qualified as an assistant. Staff that were present either qualified as a trainee or substitute.

3.4.6.1 · The licensee shall maintain a record of the date of each evacuation drill as required in the rules in section 3.7.2 of these regulations that includes the number of children and staff evacuated, time taken to evacuate, and notation of the drill conducted while children were sleeping or resting. Evacuation records shall be kept for two (2) years. When the CBCCPP counts lock-down drills as allowed in the rules in section 3.7.2 of these regulations, the licensee shall maintain a record of the date of each lock-down drill, the number of CBCCPP children and staff who participated, and note that the drill performed was a lock-down drill.
During the visit, the binder with the evacuation drill logs reflected monthly drills for 2019 and 2020. While staff were able to confirm that monthly drills have been regularly conducted, an evacuation drill log for the years of 2021 or 2022 was not located for review.

5.1.2 · General Health Examinations: Within forty-five (45) days of enrollment, the licensee shall obtain documentation of the child's age appropriate well care exam from the parent. Documentation shall include information regarding any health conditions and medications that may impact the care of the child.
A review of 4 randomly selected files for children who have been enrolled more than 45 days showed that 2 files did not include documentation of a General Health Exam signed by a pediatrician.
