6.2.4.8 · Trainees between fifteen (15)- seventeen (17) years of age shall be under the direct supervision of a staff member who meets teacher associate or higher qualifications as in rules in section 7.3.2 of these regulations and may not be left alone with children.

On 12/10/2026 eighteen (18) month old Child A and thirty-three (33) month old Child B, were found unattended outside, on the stairs that exit from the second floor classroom. Child A and Child B did not have shoes or jackets. Staff statements indicate the children were outside alone for less than five (5) minutes, but an exact time was not confirmed. Another staff person, not assigned to their group, noticed them and brought them back to the classroom, where staff expressed they were not aware they had left the room. After the incident occurred the director required all staff to complete Supervision : Teamwork a training provided through Better Kid Care. This is a serious violation.

During a field trip, a three (3) year old child exited the business the program was visiting. Program staff did not see the child leave the room and the child was unsupervised within a strip mall for approximately three (3) to five (5) minutes before being returned to the group by good samaritans, while the program looked for the child. This rule was previously cited in violation on 3/16/2022. This is a serious violation.

6.2.6.6 · The program director shall ensure that no person be left alone with children without approval from the Division based on the results of a background check that includes fingerprinting; with the exception of a parent may be left alone with his/her own child(ren).
A staff member has been left alone with children before completing the required fingerprint supported background clearance with the Child Development Division. Video footage shows Staff A to restrict a child's movements for over a continuous eight (8) minute timespan. Staff A restricted a child's body movements by holding a child's arms over their head for four (4) minutes while the child moved about, arched their back and attempted to pull away from Staff A . Staff A then kicked the child's leg out from under them, had the child sit on the floor and then Staff A wrapped their arms around the child's torso. Next, Staff A placed their leg over the child's body while seated on the floor to prevent the child from moving. Staff A then sat with their arms wrapped around the child while rocking back and forth. Staff statements confirm that other staff at the program have held children in a manner that restricts movements or have seen staff restrict movement as a behavior management strategy, which is not a positive guidance practice.

7.2.2 · The licensee shall ensure that all new staff and auxiliary staff, prior to working with children in the CBCCPP; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.
Eight (8) staff were issued Fingerprint Authorization Certificates ranging from three (3) months ago to ten (10) months ago and had not yet completed the Fingerprint Supported Clearance that is required.
