The program self reported to the Child Development Division that on 01/23/2026 they operated out of staff/child ratio and terminated the staff member that caused this to happen. Staff C left Staff D for twenty(20) minutes with fifteen(15) preschool aged children. The number of children in this group required two(2) staff. Neither staff alerted management that additional staff was needed at this time to maintain ratio requirements. Management was alerted several hours after the incident occured. This is a serious violation.

On 01/23/2026 the Green classroom was in the gymnasium with six(6) toddlers who were between eighteen(18) and thirty-two(32) months old. The Blue classroom arrived with fifteen(15) preschool children and the two classrooms were combined and engaged in gross motor play with a total of twenty-one(21) children. The toddlers and preschool age children interacted together in the same activities and staff supervised the group as a whole not just the children in their assigned classroom. When a child between eighteen(18) and thirty-two(32) months old is present, the maximum group size is ten(10). Green staff report that they eventually left when they realized they could not adequately supervise and ensure their groups safety due to the chaos created by having mixed age groups combined in gross motor play. Interviews with staff indicate this is not the first time the two groups have joined together for gross motor play in the gymnasium and the group size requirements were not adhered to. Staff appear to understand staff/child ratio requirements, however it appears the program does not have a system in place to ensure staff are only combining when maximum group size requirements are met. This is a serious violation.

6.2.6.1 · Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.
While in the Blue Classroom; this licensor observed the following. Child X and Child Y entered a small closet like space that is identified as the "safe space". Staff did not observed children entering this space, confirmed by observation and during staff interviews. The two(2) children were in the space without supervision for seven(7) minutes. During this time Staff A remained seated on the floor approximately four(4) feet from the half door, Staff B was on the opposite side of the classroom assisting children, and a third individual in the room (auxiliary staff) view was obstructed by furniture. At the five(5) minute mark of the children being in that space unsupervised, Staff A and B asked the children to clean up for snack. During the seven(7) minutes staff did not check on the two(2) children in that space until prompted by this licensor when I observed that Child X was lying on their stomach with the top portion of their buttocks exposed while Child Y had their face resting on Child X's buttocks where the skin was exposed. A violation was cited for this regulation on 08/21/2023. This is a serious violation.

5.2.3.6 · The licensee shall ensure that used disposable diapers are placed in a container that is washable and has a cover that prevents children from accessing the diapers.
Staff A was observed putting a soiled diaper in the open trash bin used for paper towels. Diapers must be placed in a covered container. The director stated there is a covered trash can that staff should be using, that trash can is located outside of the area where diapers are changed.

5.2.6.5 · Sanitizing of the following items shall be done on the following schedule: Before and after each use: * Food preparation surfaces; * Dining tables and highchair trays; and * Non flushing potty chairs. After each use: * Eating utensils and dishes; At the end of each day: * Food preparation appliances; * Plastic mouthed toys; and * Pacifiers.

5.2.3.11 · Each diaper changing procedure shall include: * Preparation: assemble supplies, staff member washes hands, prepares changing surface with either a disposable covering or ensure that the surface was recently cleaned and disinfected and bring the child to the diaper changing area. * Dirty Phase: remove soiled diaper, dispose of diaper, and cleanse diaper area of the child. * Clean Phase: put on clean diaper, dress child, and wash the child's hands. * Clean up: clean and disinfect the diaper changing surface, and staff member washes their own hands. * Record diaper change.
In the green classroom I observed Staff A change diapers after outside time. During this time they completed four diaper changes while wearing the same medical gloves. Staff A had children was their hands but did not change gloves or wash their own hands. I also observed Staff A spray the disinfecting product on the changing table and quickly wipe it off. Not allowing it to set on the surface per the product instructions.

2.3.9.3 · The licensee shall ensure that all staff have met ongoing background check requirements by submitting at least once every five (5) years a Records Check Authorization form to the Division and as required shall submit to fingerprinting.
On 11/06/2024 a violation was cited for this regulation. The following corrective action was not received, a reminder email was sent on 06/26/2025, no response was received. A voicemail was left for Director Melinda Pearson, that call was not returned. Immediately, and before working in the program, Staff D must submit a Record Check Authorization form to the Division for processing. Before being left alone with children, Staff D must submit to fingerprinting and receive fingerprint supported background check results. Develop a system to prompt Record Check Authorization forms to be submitted to the Division for each employee at least once every five (5) years, and submission to fingerprinting as required, moving forward. In the corrective action email please provide evidence that Staff D has submitted to fingerprinting and include details of the system developed to ensure compliance moving forward. It should be noted the program did send a record check authorization form, CDD has not received fingerprint results and the program has not submitted documentation that supports Staff D complied with the fingerprinting requirements.

6.2.7.3 · Staff shall use positive methods of guidance and behavior management that encourage self-control, self-direction, self-esteem, and cooperation.
While observing in the Orange classroom, the voice of Staff A was heard coming from the Blue Classroom shouting, "No! No Playing!" Upon entry into the Blue Classroom, all children were on their rest mats and three staff members were sitting at a table. Several of the children were awake on their mats. Later during the visit, while again observing in the Orange Classroom, Staff A's voice was heard shouting, "No! We aren't doing that right now!" A child's voice was then heard asking why. Staff A's voice was again heard shouting, "Because we just aren't!" Upon entry to the Blue Classroom, Staff A had the children at the circle space. Child X was observed to be walking around the other children who were sitting. Child X was talking, playing with toys and sometimes lifting chairs into the air. Child X continued to be disruptive and look at Staff A as though looking for a response. Neither staff in the classroom responded to Child X while Licensors were in the classroom. This is a repeat violation which was cited during the site visit on 05/09/2024.

5.4.3.2 · Children shall not be required to sleep. Children who do not nap shall be provided space and equipment for quiet play.
Upon entry to the Blue Room at approximately 2:05 PM, there were multiple children awake on their rest mats. The three staff members in the room were sitting at the table. The awake children did not have any alternate activities, toys or materials on their mats. Staff B stated that the children who do not normally sleep are not given books or other quiet activities but are expected to stay on their mats for thirty to forty minutes at the beginning of rest time. Staff A and B stated that children are allowed to go to the table for quiet activities after the otehr children fall asleep. Staff A stated that three children who did not sleep on 07/24/2024 were invited to do activities at the table, but were not able to listen or be quiet and were therefore sent back to their rest mats without activities. Staff statements confirmed that rest time began at about 12:45 PM on 07/24/2024. This is a repeat violation.

6.2.7.3 · Staff shall use positive methods of guidance and behavior management that encourage self-control, self-direction, self-esteem, and cooperation.
Multiple staff statements confirm that preschool age children who were exhibiting screaming, hitting, punching, running around, and throwing items were required by staff persons to sit at the eating table with their chairs pushed into the table so that child's abdomen was against the surface of the table. Staff were reportedly positioned behind the child in a chair or standing over the child with the staff persons hands placed on the side of the table or palms on the table top on either side of the child's body. The staff person's feet or body weight was used against the chair legs to keep the chair in place. The information gathered indicates this technique was initiated in Fall 2023 and was still in practice as of the last week of May 2024. Staff describe children being required to walk over to the seat and/or staff hands placed upon children's upper arms and staff walking directly behind child to the seat. Children reportedly pushed their feet on the floor, pushed against the back of the chair, and flailed their arms at their sides while required to sit. Some children were heard making statements that they wanted to get up from the table or wanted the staff person to leave them alone. Children were reportedly allowed to stand up when they agreed to stop behavior or became quiet.

6.2.5.2 · Staff shall appropriately hold, touch, smile and talk to children.
During an observation of the program, the voices of the blue room staff could be heard through the wall into the orange room. Staff persons were heard repeatedly calling to children and were observed while in the room speaking in a raised voice to children on the opposite side of the room. Staff person A in the orange room, was observed using a strict tone and raised volume of speaking to a child who was running around during rest time. The same staff person was observed saying "Come on" to the same child in a volume that could be heard two classroom distances away while in the hallway with the child. The child was opening a door and the staff person made the loud statement while assisting the child back from the doorway. Interviews of staff persons indicate that multiple staff persons have been heard either using a volume that was reported to be yelling at children, and in other instances using tone that was deemed harsh, aggressive and/or not how the reporting staff person would want to be spoken to.

Upon review of diaper checks/changes for four (4) children during awake hours, it was discovered that on each day reviewed there were one (1) or more times they were in the same diaper without a check or change past the two (2) hour requirement. 5.1.1 · The licensee shall ensure that the CBCCPP environment and practices support children's health and safety.
Child A exited the playground gate and made it to the travel portion of the road before staff were able to retrieve the child. It was discovered during the investigation there were identified issues with the gate door properly closing and latching therefore a staff person was assigned to the gate to monitor, however this person was also counted in ratio and by regulation required to provide supervision and attend to children's needs despite the gate assignment. Staff B was attending to a child's needs while standing at the gate when Child A pushed against the gate and it opened allowing them to exit the playground. Staff B requested assistance from Staff C who was also on the playground, and attempted to exit the gate but struggled with getting the gate to open again before being able to retrieve Child A.

Staff D stated this to the other staff in the room and it was reported they were unaware that Child J was still outside. 3.4.6.5 · Staffing Schedule: A licensee shall maintain a written record of the daily schedule for at least 365 days of all staff including exact days and hours worked and the group of children to whom they are assigned.
A review of staff schedules and children's attendance on 7/25/23 found that Staff A was in the Purple Classroom from 8:15-12:00, but documents also show that Staff A signed children in prior to 8:15 and signed children out after 12:00 from that group which indicates a discrepency of when Staff A was with that group of children. On 7/25/23, Staff E shows they left at 4;25 both on Brightwheel and the paper system, yet the last child from that group was signed out at 4:43 by Staff F who had not been in that room since 8:00 am. 3.2.5 · Self-reported violations: If an incident or situation occurs in a CBCCPP while children are present that could be considered a serious violation as defined in the rule 2.2.50 of these regulations, the licensee has a responsibility to self-report this to the Division within twenty-four (24) hours of the incident. A complete report will include a description of the incident, what the licensee has done to verify the particulars of what occurred, and how the licensee has taken corrective action to ensure the safety and well-being of children and to prevent a future serious violation. If such a report is received in a timely manner from a licensee with a history of consistent regulatory compliance, no child has been seriously injured or harmed as a result of the incident or situation, and the licensee has taken prompt and appropriate corrective action; the Division may, on a case by case basis and at the Division's discretion, elect to issue a warning, rather than a violation related to that incident or situation.

On 8/16/23 Staff C went on break leaving their group of seven (7) children on the playground without staff coverage. On 8/9/2023 two (2) children were located inside the building without the staff assigned to that group knowing the whereabouts of those children. Staff report having told the children to request assistance from another staff member on wanting to go inside, while the other staff member states the children never sought their assistance. While a staff member from another group went inside the building after noticing the children had entered, they discovered a third child in the building unattended by staff. 6.2.8.4.1 · The program director shall consult with the child's parent(s) and professionals, as appropriate, to develop and implement a plan to address concerns, with the goal of continuing the child's enrollment.
The program provided periodic updates on Child A's behavior to their family but had not indicated care was at risk of ending. 6.2.8.4.2 · In the event that the concerns cannot be resolved, written notice to the child's parent(s) is required with at least five (5) days' notice prior to expulsion.

5.8.3 · Staff shall create and file an incident report for each accident, injury or medical emergency that leaves a visible mark, or first aid has been administered, even when medical treatment is not required. An incident report shall include the name of the child, date, description of the injury or medical emergency, how it occurred, adult witnesses, first aid provided, and medical care required. The child's parent shall be provided a copy of the report at pick up that day. Serious injuries, animal bites and death must be reported to the Division as specified in the rules in section 3.2 of these regulations.

3.2.1 · Serious injury or death of a child: The licensee shall make a timely report to the Division of any injury or accident involving an enrolled child resulting in in-patient or out-patient medical or dental treatment or death. In the event of a death, a verbal report shall be made immediately followed by a written report within twenty-four (24) hours. In the event of an injury or accident resulting in in-patient or out-patient medical treatment, a verbal report shall be made within forty-eight (48) hours and the written report shall be made within five (5) business days.

5.10.3.3 · Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.
On 08/20/2020 the program submitted an incident report stating that Child A fell while off a swing while playing outdoors, and as a result chipped a bone in his arm. Through an email correspondance on 09/08/2020, Staff A stated that the program used the playground despite previously identifying the need for additional wood chips which had not yet been replenished.
