5.10.1.1 · General Safety: The licensee shall ensure the physical facilities of the CBCCPP, grounds, equipment, and toys present no hazard to the health, safety, and well-being of the children.
In both the one (1) year old and three (3) year old rooms the baseboard heaters were observed to be missing metal caps, exposing sharp edges to children.

7.4.4 · All staff shall complete fifteen (15) clock hours of annual professional development activities as required in the rule 7.4.2 of these regulations. Substitutes filling a staff position for less than thirty (30) consecutive days within a 365 day period shall be exempt.

Upon review of Staff BFIS Quality and Credential accounts and on-site staff files it was identified that Staff A, B, and C had not obtained training in pediatric first aid and infant and child CPR within three (3) months of beginning work. The staff had been working in the CBCCPP for five (5) months- one (1) year. In addition, Staff D's training in first aid and CPR had expired.

5.10.1.8 · Childhood Lead Poisoning Prevention The licensee shall comply with the requirements of 18 V.S.A. Chapter 38 Vermont Lead Law and shall ensure that Essential Maintenance Practices (EMP) is performed. This includes but is not limited to protecting children from peeling or chipping paint, and dust build up from the friction of moving doors or windows.
Upon review of the Vermont Department of Health's IRC Compliance database it was identified that IRC practices had not been conducted at this program in the last three hundred sixty-five (365) days as required. Director statements confirmed this.

3.4.7.3 · Within six (6) months of the initial date of employment; staff and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations, and the program director shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications, and all annual professional development activities as specified in the rules in sections 7.3 and 7.4 of these regulations shall be submitted to Northern Lights at CCV to be verified and maintained in BFIS.

5.4.1.4 · Cots, mats, and mattresses shall be nonporous or have nonporous coverings. Each child shall be provided clean, individual bed linens either by the licensee providing them directly or requiring parents to provide them. No child shall nap directly on nonporous coverings.
During the visit it was observed that four (4) nap mats in the two (2) year old room, four (4) mats in the three (3) year old room, and five (5) mats in the four (4) year old room were ripped, making them porous.

5.10.1.1.2 · Children shall be protected from choking hazards presented by cords on window coverings, electric or electronic appliances or equipment and telephones.
During the visit several loose cords were observed in multiple classrooms, presenting choking hazards to children. The loose cords included the following: a telephone, fish tank, and two (2) air conditioner cords in the four (4) year olds classroom, two(2) cords to infant swings and a portable sink cord in the infant classroom, and a long orange extension cord in the three (3) year old classroom.

5.2.3.4 · The licensee shall ensure that there is a sturdy diaper changing area with a clean, washable and non-absorbent surface. The diaper changing area shall not be located in the kitchen or any area where food is stored, prepared or served.
During the visit four (4) mats intended for use as diaper changing surfaces were observed to be ripped, making them absorbant. This does not meet the requirements of this rule.
