3.3.3 · The FCCP shall establish a system for taking attendance, including documentation of the time when each child arrives and departs each day he/she attends the FCCH. The FCCP shall save all daily attendance records identifying the hours of children s attendance for at least twelve (12) months from the date that care is provided.
Upon arrival four (4) children were in attendance; three (3) children were signed in. Child A arrived at 7:45 but had not been signed in at 10:00.

6.2.4.4 · When children are outside playing, the FCCP and/or staff shall be outside supervising the children. If due to the mixed ages of the children and the need to step away to meet basic care needs of children, the FCCP and/or staff may supervise the school age children from inside the home provided that the children can be seen from inside and the outside play area is fenced to prevent the children from leaving the play area. Children younger than school age shall not play outside without the FCCP and/or staff person present at any time.
Upon arrival the Provider was inside with one (1) child who was sleeping, while three (3) children were outdoors with a thirteen (13) year old. No staff were present. This is a serious violation.

5.2.3.11 · Each diaper changing procedure shall include: * Preparation: assemble supplies, staff member washes hands, prepares changing surface with either a disposable covering or ensure that the surface was recently cleaned and disinfected and bring the child to the diaper changing area. * Dirty Phase: remove soiled diaper and cleanse diaper area of the child. * Clean Phase: put on clean diaper, dress child, and wash the child's hands. * Clean up: clean and disinfect the diaper changing surface, dispose of diaper, and staff member washes their own hands. * Record diaper change.
The Provider changed a child's diaper but did not wash the child's hands or disinfect the diaper changing pad upon completion of the change. The diaper changing pad remained in the living room area where children were observed playing directly next to. The diaper change was not recorded. This is a repeat violation.

6.1.4.2.1 · The FCCP shall ensure that the amount of awake time children under twenty-four (24) months of age spend in any confining equipment, such as a crib, playpen, port-a-crib, swing, or seat is limited to less than thirty (30) minutes in any two (2) hour period.
Child B was observed in a saucer seat from 10:08 until 10:54; sixteen (16) minutes longer than the rule allows. Child B was then placed back in the saucer seat from 10:57 until 11:00.

5.10.1.10.3 · All poisonous or toxic materials shall be inaccessible to children.

5.10.3.1.4 · If fencing is used, it shall be sturdy, safe and reinforced to give support, constructed to discourage climbing, and shall not prevent visual supervision of children by the FCCP and/or staff.
The fence around the outdoor play area had panels that the top and bottom reinforcements were broken resulting in jagged wood, and the sturdiness of the fence to be compromised. The entire fence had areas of raw wood with chipped paint, resulting in paint flakes on the ground inside the fenced area.

Provider A was observed changing two (2) diapers. Both times, Provider A did not wash her hands prior, the diaper changing pad was not properly cleaned and disinfected, and the diaper changes were not recorded. Additionally, Child A's clean diaper was put on him, then the diaper area was cleansed.

5.11.1.3 · The FCCP shall ensure that menus are planned in advance, dated, and posted so that they are clearly visible to parents. Any changes to the posted menu shall be noted. Menus of meals and snacks for the preceding six (6) weeks shall be kept on file.

3.3.7.3 · Within six (6) months of initial date of employment, the FCCP and all staff shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications, and all annual professional development activities as specified in the rules sections 7.3 and 7.4 of these regulations shall be submitted to NLCDC to be verified and maintained in BFIS.
Upon review of Provider A's BFIS quality and credential account, it was found to be incomplete. Provider A was missing verification of minimally a high school diploma, or GED, and documentation of completing the required Reporting Abuse & Neglect training. Provider A was able to show documentation on site of her college transcripts, and provided documentation after the visit of completing the Reporting Abuse & Neglect training.
