7.1.3 · The licensee, in consultation with the program director, shall establish written program policies and procedures and provide these to staff and to auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations during an orientation training session approved by the Division prior to being left alone with children. Trainees under eighteen (18) years of age and other staff not left alone with children shall complete the orientation training within at least one (1) month of their first date of working with children. Complete written information and the orientation training session shall include: Basic knowledge of child growth and development; Routine and emergency health protection of children including health related exclusions; Safety and sanitation requirements including handling and storage of hazardous materials and disposal of bio contaminants; Positive behavior management; Supervision of children; Child accident and injury procedures including building and physical premises safety; Safe sleep practices; Administration of medication requirements; Emergency and evacuation requirements; Nutrition and food safety including prevention of and response to emergencies due to food and allergic reactions; Recordkeeping; Transportation and child passenger safety; Release of children; Respectful engagement of families; Preventing, recognizing, and reporting child abuse and neglect; including information about the signs and symptoms of sexual abuse, sexual violence, grooming processes, recognizing the dangers of child sexual abuse, and other predatory behaviors of sex offenders; Recognition of and response to the symptoms of common childhood illnesses; Preventing the spread of infectious disease; Providing developmentally appropriate activities and experiences for children; Inclusion of children with special needs; Guidelines for volunteers, partner staff, auxiliary staff, and business managers; Responsibility to comply with current applicable licensing regulations; Staffing requirements to include opening and closing; and Ensuring children have extra clothes and diapers available.
At the time of the visit eight(8) staff members had not completed an approved program orientation training.

5.9.2 · Staff shall plan for the full and successful inclusion of children with special health care needs, disabilities, and/or English Language Learners. An individual child's plan shall be developed with the child's parents and staff. The plan shall address any health or other particular needs of the child.
During my licensing visit and follow up meetings it was determined that not all Preschool staff were aware that Child A's rescue medications must go outside and are readily accesible, there was confusion over whether medications were stored in the classroom or in the nurses office and it appears the program does not have a system in place where important medical information is shared with staff that work in the Preschool classrooms. It should be noted that this licensor contacted Child A's parent and they confirmed that the medications need to travel with Child A outside and they were told the medications were stored in a backpack that staff brought outside with them.

3.4.7.5 · The licensee shall maintain a current list of the licensee or designee, staff, auxiliary staff, and volunteers as in the rules in section 7.7.5 of these regulations, as applicable in BFIS. Any changes shall be reported through BFIS within five (5) working days of the change.
Seven(7) individuals were listed on the program's BFIS account as staff members, however they were no longer working in the Preschool classrooms. Guidance was provided that it is acceptable to leave substitutes on the list even if they have not recently worked in the classroom, however any staff that have left employment or it is known will not return to the Preschool must be removed.

7.1.2.1 · The licensee shall ensure that at least one (1) staff who has successfully completed and is currently certified in pediatric first aid and in infant and child CPR is on the premises at all times children are present.

5.6.11 · Prescription rescue medication, such as rescue inhalers, epinephrine (epi) pen, and seizure medication must be kept immediately accessible for use in cases of emergency.
Child A who attends Preschool in Ms.Crown's classroom has an Epi Pen for allergic reactions to insect stings and an inhaler for a pollen allergy. These rescue medications must travel with Child A when they go outside. During this visit the classroom assistant was covering for Ms. Crown, who was absent. When asked about medications they stated that medications are kept in the nurses office. Discussion with the nurse indicated they were in the classroom. The nurse and I returned to the classroom and after searching for several minutes located a white metal box with the medications inside. The Epi Pen and inhaler were not accompanying Child A outside according to the assistant and had not been with them on today's hike. Once the box was located staff that were present were told that rescue medications for Child A or any other child must be out of reach of children but easily accessible to staff, the current system of storage was not allowable. On 11/15/2025 this licensor met with the school administrators, Rachel Hartman, Bethany Hale and Superintendent Matthew Foster. During this meeting I discussed how to properly store rescue medications in accordance with this regulation and the expectation moving forward is that Child A's medications travel with them outside. Rachel planned to follow up with Ms. Crown to ensure Child A's rescue medications were accompanying them outside and to confirm that the medications were moved out of the box and were in a location that was easliy accessible and the location was known to all staff. A follow up meeting was scheduled on 12/05/2025 where I would meet with staff and review medication storage and confirm that Pre-K staff are now aware of where the medications are stored. During the 12/05/2025 Ms. Crown was not present,the assistant that was present during my licensing visit was present and was asked where the medications are now stored. The assistant was not entirely sure and a brief conversation ensued and I was told they were now stored in a locked box, near the special educator's space which is connected to the main classroom and the key was hung nearby. This system now made the medications less accessible as they are stored in a lock box which could cause a delay during a medical emergency. Based on conversation with staff present during the meeting it was unclear if Child A's medications were now accompanying them outside. It should be noted that this licensor spoke with Ms.Crown on 12/17/2025 and she stated that the medication has accompanied Child A outside but the assistant may not have been aware of that fact. She also stated that she was not locking the box. The violation stands because in her absense staff were not aware of the location of the medication and did not bring it on their hike the day of the licensing visit.

7.1.2.2 · Staff who are counted in the staff/child ratios and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations shall obtain training in pediatric first aid and in infant and child CPR within three (3) months of beginning work in the CBCCPP and remain currently certified.
A review of staff BFIS quality and credential accounts reflected that Staff A did not have current certifications in infant and child CPR or pediatric first aid. Staff A's start date is 09/08/2021. Staff A was counted in ratio and left alone with children during the visit. During the debrief on 01/25/2022, Staff B confirmed that Staff A did not have current certifications in infant and child CPR and pediatric first aid at the time of this visit and that Staff A is regularly counted in ratio and left alone with children.

3.4.7.3 · Within six (6) months of the initial date of employment, staff working with children and the program director shall maintain an up- to-date BFIS Quality and Credential Account. Documentation, verification of qualifications and all annual professional development activities as specified in the rules in sections 7.3 and 7.4 of these regulations shall be submitted to NLCDC to be verified and maintained in BFIS.
The BFIS quality and credential account for the program director and staff were reviewed and were missing up to date CPR and First aid certification, mandated reporting training, VT orientation training, annual professional development training hours for the year and educational diploma and/or transcripts.
