3.7.2.2 · The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes. Licensees of a CBCCPP located within a public or independent school building may count a lock-down drill performed while the CBCCPP is in operation in place of a monthly evacuation drill with the CBCCPP children and staff and at least three (3) of the monthly drills conducted within 365 days shall be evacuation drills.

3.6.1 · Staff shall release a child only to persons authorized by the parents as specified in the rules 3.4.4.1 and 5.10.6.6.1.2 of these regulations. When a person authorized to pick up a child is unknown to staff, his/her identity must be verified prior to releasing the child.

6.2.7.2 · Staff's expectations of children's behavior and responses to children's behavior shall be appropriate to each child's level of development and understanding. Guidance shall be designed to meet the individual needs of each child.

6.2.5.2 · Staff shall appropriately hold, touch, smile and talk to children.
During an observation in the classroom, a staff was saying to a child in a loud harsh tone: that is enough, stop it and sit down. Interviews with staff indicate an ongoing concern regarding this individual tone of voice and volume used when speaking to children. It was explained that the staff member is heard speaking at a loud volume and using a stern, harsh voice that would not be conducive to a nurturing environment.

6.2.6.4 · When children are outside playing, staff shall be outside visually supervising the children.
For nine (9) minutes, children were playing inside an in-hill tunnel and the slide structure while the staff sat in the gazebo. It is impossible to see inside the tunnel or the slide structure from the gazebo.

6.1.2.4 · Staff shall be interacting with children during outside play.
Staff A was observed standing by the gazebo, arm crossed over her chest or in her pocket looking around the playground without engaging with the children for a period of 28 minutes. Staff B was seen sitting in the gazebo, looking at her personal phone instead of engaging with children for the majority of the 1 hour 45 minutes, they were outside. Both staff had little interaction with children unless they came to speak with them.

6.2.5.10 · Staff's voices shall not dominate the overall sound of the group.
During the 1 hour and 45 minutes the children were outside were outside, Staff A was observed yelling at children on seven (7) occasions and staff B yelled three (3) times. Voices were loud enough to be heard across the street. You could hear staff yelling, stop that, do not do that, you are being naughty.

It was observed while outside, Staff A pulled a child away from the in-hill slide, by grabbing her by one forearm with her feet came out from under her. Staff A was seen grabbing 2 boys by their forearms forcefully guiding them to the gazebo where they were told to sit. 3.4.7.5 · The licensee shall maintain a current list of the licensee or designee, staff, auxiliary staff, and volunteers as in the rules in section 7.7.5 of these regulations, as applicable in BFIS. Any changes shall be reported through BFIS within five (5) working days of the change.

5.10.3.3 · Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.

5.2.1.1 · CBCCPP staff shall ensure that adults and children wash their hands: * Upon arrival at the CBCCPP; * Before they eat, prepare or handle food; * Before and after handling raw meat; * Before feeding children; * After toileting or diapering; * After cleaning; * After taking out the garbage; * After handling animals; and * After outdoor play.

5.10.3.1.4 · If fencing is used, it shall be sturdy, safe and reinforced to give support, constructed to discourage climbing, and shall not prevent visual supervision of children by staff.
There is a 10 foot drop off located approximately three (3) feet from the fencing on the back edge of the playground, which is bordered on two other sides by a parking lot. This fencing, which is required to protect children from harm, is in disrepair and at risk of failure. A large portion of the chain link fence is disconnected from the top rail allowing movement when pushed. The chain link fence is also disconnected from the post where the gate attaches, leaving a ten (10) inch space that children can squeeze through. In two separate locations the top rail is completely disconnected from the post. While facing the playground from the parking area, a portion of the top rail is missing completely, allowing the fence to move freely and children push through.
