6.2.4 · Supervision of Children The FCCP and/or staff shall ensure visual supervision of children except as allowed in rules 6.2.4.1 - 6.2.4.4 of these regulations.
Upon arrival to the FCCH, the provider was in the outdoor play area supervising eight (8) children of mixed ages between ten (10) months and eight (8) years old. When asked about the number of children in care on this day, the provider stated that the five (5) month old infant was inside sleeping. She stated that she was checking on them every fifteen (15) minutes while the rest of the children continued playing outside. The napping infant was sleeping in a bedroom located through the entryway, through the kitchen, and through the dining room, approximately 50 feet from where the provider stood supervising the other children. The infant was sleeping in a portable crib in a bedroom, with the door closed and white noise machine playing loudly. The provider stated that the infant fell asleep in the stroller outside during their outdoor play time. The provider transferred the infant to the crib in an effort to be in compliance with rule 5.4.2.3. The provider stated that the infant had been sleeping inside for about twenty (20) minutes. The distance between the location of the children playing outside and the location of the sleeping infant, along with the closed entrance door, closed bedroom door, loud noise machine significantly impacted the provider's ability to visualize, hear and physically respond immediately to the sleeping infant or the group of children remaining outside unsupervised. This is a serious violation.

5.6.6 · The FCCP shall ensure that all prescription medication is in its original container, properly labeled for the child, and administered prior to the expiration date on the container.

7.2.2 · The FCCP shall submit a Records Check Authorization form to the Division for any new individuals, sixteen (16) years of age or older, residing in the FCCH or present more than five (5) times in 365 days during the FCCH's hours of operation as required in the rule 2.3.7.2 of these regulations.

5.10.1.8 · Childhood Lead Poisoning Prevention The FCCP shall comply with the requirements of 18 V.S.A. Chapter 38 Vermont Lead Law and shall ensure that Essential Maintenance Practices (EMP) is performed. This includes but is not limited to protecting children from peeling or chipping paint, and dust build up from the friction of moving doors or windows.
The family child care home was built in 1965 and required to comply with Vermont Lead Law Essential Maintenance Practices, now referred to as Inspection, Renovation, and Cleaning (IRC) requirements. It was confirmed with the Vermont Department of Health that the compliance statement for 2024 was not submitted. V10 · Children in care shall be protected from any and all conditions which threaten a child's health, safety and well-being. This includes protecting children from stoves, pools, poisons, window covering pull cords, asbestos, wells, known vicious animals, medications, dust or chips from lead paint, traffic, and other hazards.
