3.4.7.3 · Within six (6) months of the initial date of employment; staff and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations, and the program director shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications, and all annual professional development activities as specified in the rules in sections 7.3 and 7.4 of these regulations shall be submitted to Northern Lights at CCV to be verified and maintained in BFIS.

In the Preschool classroom, identified as Apple Tree, Staff A dismissed the children from the snack table and sent them to Staff B who was near the sink gathering the dirty dishes. During this time I observed Child X leave the group and head to the corner of the the classroom where they started to play with a toy, it appeared that staff did not observe this as Child X was not asked to join the group at the door. Meanwhile Staff A went to the door and stood in front of the group, Staff A told Staff B she was taking them to the hallway bathroom. As they left the classroom Staff B continued to clean in the kitchen area, after approximately three (3) minutes Staff B left the classroom and joined the group near the cubbies in the hallway. I remained in the classroom with Child X. After about thirty (30) seconds I observed Child X stop playing and look around the room. He looked at me and then headed to the door. I followed Child X out, and observed Staff B look in our direction. She seemed suprised to see us exit the classroom. I told Staff B that Child X was left behind in the classroom. Child X was directed to use the bathroom and reminded that they need to stay with the group. During my observation period in this classroom I did not observe Staff A or Staff B counting children. While I was in the Maple Tree classroom I did observe staff counting children multiple times and communicating with each other that the group was all accounted for during transitions. This is a repeat serious violation for supervision in the classroom, the last violation was cited as the result of an incident that occured on 04/02/2024. Continued non compliance could result in further licensing action.

5.2.4.1 · Children shall be accommodated in a timely manner when they need to use the toilet.
Child X climbed onto the cubbies and as a result Staff C moved Child X to a chair. While Staff C was talking about the incident with Child X, Child X stated that they needed to pee. Staff C told Child X that before they could use the bathroom they needed to tell Staff C that they heard what was said to them about not climbing onto the cubbies. Child X did not answer the question and instead began to urinate in their pants. Staff C then brought Child X into the bathroom where they could finish urinating. This information was gathered from a written incident report that was provided to the parents and kept on site in the child's file.

5.1.1 · The licensee shall ensure that the CBCCPP environment and practices support children's health and safety.
The program was storing matches in a basket that was identified as a teacher only basket. During an interview Staff B stated that all children should know and understand that they are not allowed to go into those baskets.Children observe the mechanics of lighting a match each day at lunch when staff light a candle. It is not a developmentally appropriate practice to assume that children who are three to six years old will possess the self control not to go into one of the teacher baskets.

5.10.2.1.5 · Children shall be permitted in the meal preparation areas only when under the direct supervision of staff.
On 03/21/2024 Child X had access to a box of matches, lit a match resulting in a corner of the matchbox getting set on fire. Staff A stated that upon entering the building from outside time, Child X was sent to was their hands at the sink in the kitchen area of the classroom. To reach the sink Child X would have stepped onto a stool that is approximately a foot high and is located next to a mini fridge that is approximately three feet tall. Staff reported that the matches were in a basket on the top of refrigerator. When children are in an area used for food preperation children must be under direct supervision of a staff member. Staff A stated that they were in the hallway and Staff B stated they were in the classroom starting circle time. Direct supervision was not maintained on Child X as the child had time to reach the matches and set the matchbox on fire. Staff B only noticed the fire when they heard children yelling at Child X and then heard Child X state they lit a match. Staff A and B could not tell this Licensor any details on how the fire was set. They assumed the child climbed onto the counter and then onto the refrigerator to access the matches. It should be noted that the program has a bathroom with a sink in the hallway that could have been used for handwashing.

3.2.5 · Self-reported violations: If an incident or situation occurs in a CBCCPP while children are present that could be considered a serious violation as defined in the rule 2.2.50 of these regulations, the licensee has a responsibility to self-report this to the Division within twenty-four (24) hours of the incident. A complete report will include a description of the incident, what the licensee has done to verify the particulars of what occurred, and how the licensee has taken corrective action to ensure the safety and well-being of children and to prevent a future serious violation. If such a report is received in a timely manner from a licensee with a history of consistent regulatory compliance, no child has been seriously injured or harmed as a result of the incident or situation, and the licensee has taken prompt and appropriate corrective action; the Division may, on a case by case basis and at the Division's discretion, elect to issue a warning, rather than a violation related to that incident or situation.
On 03/21/2024 a child lit a matchbox on fire and staff were required to extinguish the fire in the sink. This would be considered a serious incident that put all of the children's health and safety at risk. The program did not notify licensing about the incident until 03/26/2024. Furthermore, the child's parents were not notified until pick up at the end of the day and the families of children in care were not notified until 9:55 pm on the day of the incident.

5.10.1.10.1 · All containers of poisonous, toxic, or hazardous materials present in the CBCCPP shall be labeled for easy identification and used only in such a manner and under conditions that will not contaminate food or create a hazard to the children or staff.
On 04/02/2024 the matchbox in the Appletree classroom was covered with construction paper. Matches are considered a hazardous material and the label states keep away from children. I notified the Licensee the day of the visit that the construction paper must be removed from the matchbook or the matchbook needed to be replaced by one that has not been altered. The Licensee emailed this Licensor on 04/03/2024 and stated they would ensure all matches in the classrooms are in their original, unaltered containers. During a follow up visit on 04/05/2024 I noted that the matchbox with the construction paper was still in the classroom and was still being used to light the candle during lunch. I originally was not going to cite this violation, however the program's failure to follow through with this Licensor's directive resulted in the decision to cite this violation. During a follow up meeting on 04/17/2024 the Licensee stated that they did go through the room to replace matches but missed the one in question.

5.6.5 · All prescription medication administered by staff shall be in its original container, properly labeled for the child, and administered prior to the expiration date on the container.

3.7.2.2 · The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes. Licensees of a CBCCPP located within a public or independent school building may count a lock-down drill performed while the CBCCPP is in operation in place of a monthly evacuation drill with the CBCCPP children and staff and at least three (3) of the monthly drills conducted within 365 days shall be evacuation drills.
The fire drill documentation and confirmation from staff, the program did not conduct a fire drill or lock down drill in December 2021, February 2022, May 2022, and June 2022.
