2.8.2 · When a parental notification letter, due to a serious violation is required, the Division representative shall inform the licensee of this requirement in writing, including reasons and factual basis for the violation and its designation as a serious violation. The licensee shall mail the PNL to the parent of each enrolled child. When the child's parents are separated or divorced a copy shall be mailed to each parent if both are known to the licensee. A serious violation was cited at your program on 02/05/2025 for a violation of group size. As part of the corrective action to this violation and as dictated in Vermont Statute, you were required to complete a Parental Notification Letter to all families by 02/17/2025. 5.10.4.4.3 · The licensee shall ensure the bathroom is equipped with properly functioning toilet(s) and hand sink(s) that meet criteria in the rule 5.2.1.5 of these regulations.
Upon arrival at the program toilet paper was observed un-flushed in the toilet. Upon attempting to flush the toilet three (3) times in a thirty (30) minute timeframe, the toilet water was observed to raise to the top of the bowl each time, but the toilet paper did not go down the drain. In addition, Staff members reported that typical practice had been not to flush the toilet when the water level was "too high" in the toilet bowl to avoid overflowing. Staff reported one (1) instance during the prior week in which the toilet overflowed onto the floor.

5.10.1.1 · General Safety: The licensee shall ensure the physical facilities of the CBCCPP, grounds, equipment, and toys present no hazard to the health, safety, and well-being of the children.
The Licensee stated that they had been made aware of the septic system failing in August of 2024. In addition, staff reported that during months when grass was visible back to the beginning of the Summer months, moisture was visible in an area of the program's fenced outdoor play area. Staff reported being able to smell an odor that they believed to be sewage. They reported that the area had not been blocked off or made inaccessible to children, but that they were instructed to keep children away from the wet area.

6.2.1.3 · The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
Upon arrival at the program twelve (12) children were observed intermingling in the Preschool Classroom with three (3) staff present. For approximately one (1) hour this grouping was maintained. At least one (1) of the children in the group was less than eighteen (18) months of age. The group was over the maximum group size requirement of eight (8). This is a serious violation. This is a repeat violation that was previously cited on 04/04/2022.

5.10.2.1.1 · The licensee shall ensure that all on-site meal preparation shall have approval by the Division. The on-site preparation of snacks only does not require approval by the Division.
During the visit staff were observed preparing lunch for the children in care. Staff reported that two (2) meals are prepared on-site each day. As referenced during a technical assistance visit on 10/14/2014, and then printed on the License Certificate, this program is not permitted to prepare meals on-site.

3.1.2 · The owner or governing body of a CBCCPP shall comply with all applicable local, State and Federal Laws and shall be responsible for compliance with these rules established in the rule 2.3.11.4 of these regulations.
Staff reported that there was at least one (1) individual residing in an apartment above the licensed program. Staff reported preparing at least two meals per day. 6.2.1.3 · The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
Nine (9) children were present in the infant/toddler classroom, identified as four (4) infants and five (5) toddlers. Observation in the classroom found the groups operating as one group. Staff A and Staff B were asked which staff member was responsible for each group. Staff A stated that she was responsible for the older group. Staff B stated that she was Staff A's assistant. When asked, both staff stated that they move through the day all together as one group. When asked, the director stated that what I observed was typical of the way the classroom operates, and that there are nine (9) in the classroom two days a week and eight (8) children present the other three days.

6.2.1.2 · The number of children served by the CBCCPP at any one (1) time shall not exceed the maximum capacity allowed written on the license certificate.
On 21 days between January 6, 2021 and April 20, 2021, more than 19 children were present for care in this program. The dates were January 6, 7, 8, 11, 12, 19 and 20; February 1; March 2, 3, 4, 8, 9, 10, 11, 22, 23 and 24; and April 5, 6 and 7. The number of children ranged between 20-22. The amount of time per day that more than 19 children were present for care ranged between 6 minutes and 7 hours, 36 minutes.

3.4.7.3 · Within six (6) months of the initial date of employment; staff and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations, and the program director shall maintain an up-to-date BFIS Quality and Credential Account. 5.10.3.3 · Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.

5.10.4.5.2 · All interior and exterior walls, roofs, chimneys, floors, doors, ceilings, windows, skylights, stairways, ramps and porches shall be maintained in good repair.
It was observed that paint was flaking off the back porch (off infant room and within the fenced area of the outdoor play space). This includes paint on the railings as well as the porch floor. The preschool room ceiling had multiple tiles missing along the left (as you enter the program) side of the classroom due to a burst pipe, and had paper covering most of the exposed area. Shelving on the right (as you enter the program) side of the preschool classroom had paint missing from the edges of the shelving. The flooring under the shelves was old flooring and there was chipping paint present.
