7.4.4 · All staff shall complete fifteen (15) clock hours of annual professional development activities as required in the rule 7.4.2 of these regulations. Substitutes filling a staff position for less than thirty (30) consecutive days within a 365 day period shall be exempt.

6.2.1.3 · The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
On 11/12/2025, the one year old room was out of ratio and group size from 7:37 AM until 8:13 AM. At 7:37 AM, there were nine (9) children, including infants in the classroom with two (2) staff. By 7:57, there were at least fifteen (15) children, including infants in the classroom with two (2) staff. Staff/child ratio when there are infants in the group is 1:4 and group size is eight (8) children. Additionally, one (1) staff was left alone with fifteen (15) children in the classroom for approximately three (3) minutes when the other staff brought a school aged child outside to meet the school bus. Staff have disclosed that this is not the first time the program has been out of ratio. This is a serious violation.

On 11/12/2025, Staff A clocked Staff B in at 7:39 in the one year old room and clocked them out at 7:43 on the Brightwheel app. The Brightwheel app shows that Staff B clocked themselves into the two year old room at 7:44, then shows that they clocked into the two year old room at 8:13. Staff B provided a screenshot of the locator application on their phone which shows that they did not arrive to the parking lot at work until 8:11, and confirmed that they clocked in at 8:13. In addition, a screenshot of Staff B's 8:13 clock in time was provided, which confirms the clock in time. To support the sign in being completed by Staff A rather than by Staff B themselves, a text sent from Staff A to Staff C at 7:39 states that they were clocking Staff B in, so they didn't "look illegal." Staff C said they thought it meant that Staff A was clocking Staff B in. When asked, Staff A said it was just a joke. A time tracking report for 11/12/2025 shows that Staff B's clock in time at 8:13 AM was changed through Staff A's administrative account to 7:44 AM. This occurred at 8:25 AM on 11/13/2025. On 11/13/2025, Licensor Rielly was at the program for this concern and performed observations until approximately 8:45 AM. At 8:24 AM, Staff A clocked into the office. In addition, Staff A clocked three (3) other staff in who were not on site on 11/12/2025. One of the clock in times may have been an error, because they were clocked in and immediately back out in the same minute. Staff A denies that they changed Staff B's clock in time and maintains that someone must have gotten a hold of the classroom tablet while they were still logged in. Upon consultation with a Brightwheel representative, it was found that in order to access the function to modify time cards, a multifactor authentication action is needed.

6.2.6.1 · Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.
The program self-reported that staff A miscounted children during a busy transition while entering the program from outside and Child X was accidentally left on the sidewalk outside the front door of the program for approximately one (1) minute until another staff member heard Child X knocking on the front door. This is a serious violation.
