2.5.2.5 · Providing false information, incomplete information, or misrepresentation of facts in obtaining a license, renewing a license, or in the operation of the CBCCPP;
On 2/5/2026, Licensor Rielly emailed the director to follow up from the 1/23/2026 compliance visit to inform her that Staff A was overdue for fingerprinting. Staff A was removed from the program's BFIS account on 8/31/2024 and then returned on 4/28/2025. This is over 180 days, which means that Staff A must be fingerprinted. The director emailed back the same day and attached the fingerprint approval dated 8/14/2024, which aligns with Staff A's previous employment dates of 6/21/2024 through 8/31/2024. A review of Staff A's BFIS account and the program's BFIS account shows that Staff A's start date had been changed to show that employment was continuous, and that the change was made under the director's account on 2/5/2026. Staff A's record check authorization form was signed and submitted to the Division on 4/23/2025 with a start date of 4/28/2025 identified on the form. In addition, in a previous complaint investigation, Staff A's start date was noted as being 4/28/2025 in investigation logs.

5.1.2 · General Health Examinations: Within forty-five (45) days of enrollment, the licensee shall obtain documentation of the child's age appropriate well care exam from the parent. Documentation shall include information regarding any health conditions and medications that may impact the care of the child.

7.2.1 · The licensee shall ensure that any new individuals regularly present at the CBCCPP submit a Records Check Authorization form to the Division prior to working with children in the CBCCPP.

5.10.7.6 · Children shall be physically and visually supervised by staff at all times when on field trips or walking field trips.
On 7/26/2023, Staff X was petting a dog and talking to the person with the dog, while Staff Y was faced toward the children. Then, both Staff X and Staff Y were petting the dog and talking to the person with the dog, and neither were focused on the group of children they were responsible for, many of whom were running around in the grassy area with no barrier to keep them from entering one of the roads. The grassy area where the children were playing is bordered on two sides by neighborhood roadways, and on the front side by Route 127.

7.1.3 · The licensee, in consultation with the program director, shall establish written program policies and procedures and provide these to staff and to auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations during an orientation training session approved by the Division prior to being left alone with children. 7.3.2.3 · Teacher Assistant A teacher assistant is at least eighteen (18) years of age, is a high school graduate or has completed a GED, and meets one (1) of the following qualifications: * At least a Vermont Early Childhood Career Ladder Level One (1) or Two (2) Certificate; or * At least a current CDA (Child Development Associate) and at least twelve (12) months experience working with groups of children from grade three (3) or younger; or * At least a State Board of Education approved Human Services Program Certificate that emphasizes child development or early childhood education and at least twelve (12) months experience working with groups of children from grade three (3) or younger; or * At least successful completion of the Fundamentals for Early Childhood Professionals' course or the Vermont Afterschool Essentials Certificate and at least twelve (12) months experience working with groups of children from grade three (3) or younger; or * At least successful completion of a three (3) college credit course in child or human development or a three (3) college credit course for school age care and education and at least twelve (12) months experience working with groups of children from grade three (3) or younger.

3.7.3 · Emergency Preparedness Training: Within 365 days of opening a CBCCPP, the licensee shall attend emergency preparedness training which shall include content specifically related to sheltering in place in the event of an emergency in which the licensee and children present need to remain in the CBCCPP for an extended period.
Review of the licensee's BFIS Quality and Credential Account prior to the compliance visit and personnel file on-site indicates the required Emergency Preparedness training had not been completed. 5.4.1.1 · The licensee shall ensure that each child, except school-age children, has an individual crib, port-a-crib, cot, mat, or bed that is safe for the child's age and development, in good repair, and used by only one child each day. No child shall nap directly on the floor or on furniture not designed for sleeping. Cribs or port-a-cribs shall be used for children under twelve (12) months of age. Children shall not nap in cribs or port-a-cribs if they are physically able to climb out unassisted.

6.1.2.4 · Staff shall be interacting with children during outside play.
Licensor Layton arrived at 2:45 to the parking lot across the street from the playground used by the program. Two staff were observed with a group of children on the playground. One staff was sitting on the landing of the climbing structure and was observed on their cell phone for almost five minutes. An additional staff member was standing against the fence, observed on their cell phone for almost three minutes. During the times both staff were looking at cell phones, neither looked up to observe the children in their care, resulting in a lack of supervision and interaction between the staff and children. As a parent approached the fence, both staff put their cell phones into their pockets, and the staff person against the fence talked with the parent, while the other staff member remained on the climbing structure with no interaction with the parent or children. Once the parent left with their child, both staff took the cell phones from their pockets and looked down at the cell phones for almost three minutes, again with no supervision of, or interaction with children in care. A parent approached the fence and the staff against the fence spoke with the parent and the staff person who was sitting stood up and interacted with a child who was playing on the playground. After the parent left with their child, the two staff stood against the fence and spoke to one another and had no interactions with the children. The licensor left the parking lot at 3:00 and as the licensor observed the children and two staff on the playground, one staff person interacted with one child for approximately one minute during the 15 minute observation. Staff are required to interact with children as they play outside and during the 15 minute observation, there was approximately one minute where one staff interacted with one child.

6.2.6.2 · Staff shall know the whereabouts and activities of all school age children at all times and shall be able to physically respond immediately.
When licensor Layton approached Johanna Way, a group of five children led by one adult crossed the street and walked between McGillicuddys restaurant and the building of Future Einsteins. As the adult and children were walking between the two buildings, another group of five unsupervised children ran across the street. The children did not to look for oncoming traffic, prior to walking between the same buildings as the first group. Another unsupervised child was then seen walking across both streets, from the side of the Mosaic Hair Salon. This child did not look for oncoming traffic, prior to proceeding between the same two buildings. As the licensor drove around the building, all the children, and the one adult who were observed walking across the street and between the buildings were observed entering the main door of Future Einsteins. As a result of the lack of supervision, and inability for staff to respond if necessary, this is a serious violation.

5.2.6.6 · Disinfecting of the following items shall be done at the end of each day: * Door and cabinet handles; * Hand washing sinks and faucets; * Countertops; * Toilets and toilet learning equipment; * Diaper pails; and * Drinking fountains.
The bathroom on the right nearest the younger preschool room has a strong urine smell. The outside of the toilet bowls in the younger and older preschool bathrooms are streaked with dried urine and urine is pooled along the bottom outside of the toilets. Feces was not cleaned off the toilet seat in the older preschool bathroom after use.
