5.8.3 · Staff shall create and file an incident report for each accident, injury or medical emergency that leaves a visible mark, or first aid has been administered, even when medical treatment is not required. An incident report shall include the name of the child, date, description of the injury or medical emergency, how it occurred, adult witnesses, first aid provided, and medical care required. The child's parent shall be provided a copy of the report at pick up that day. Serious injuries, animal bites and death must be reported to the Division as specified in the rules in section 3.2 of these regulations.
Child A fell off of a play structure on 03/24/2026 at approximately 10:30 am, the parents were notified at 5:15 pm when they arrived to pick Child A up. Parents noted that Child A had marks on their face. The program did not provide a written injury report at pick up as required. The parents received a written report the following day. The Director sent the parents an email on 03/25/2026 that acknowleged the program did follow proper injury reporting requirements.

6.1.4.1.4 · Furniture and equipment children use for play and daily routines shall be durable and appropriate for the size, abilities, and activities of the children.
On 03/24/2026 twenty (20) month old Child A was injured as a result of falling from an outdoor play structure designed for children ages two (2) though five (5) years old. This injury was reported after a violation was cited for this regulation after a similar situation occured involving a different child.

On 05/01/2026 the program self reported that on 04/30/2026 Child D sustained a 1.5 cm long by 3 mm deep lacaration to their forehead which required four (4) stiches. Staff Z and Y were the staff assigned to the Ladybug/Spider classroom on 04/30/2026. Hallway video footage captured Staff Z and Y entering the Ladybug/Spider classroom with Child D and ten (10) other children at 12 pm. There was no injury visible at that time. The injury was discovered at 3 pm by Staff Z when Child D woke up from a nap. Hallway video footage captured several other staff enter and leave the classroom between 12 pm and 3 pm, those staff were interviewed and stated they did not observe an injury on Child D. This is a serious violation.

On 04/13/2026 the program submitted a self-report to the Child Development Division. The program reported that on 04/10/2026, one (1) year old Child A entered the building from the playground through a door that was held open by a staff member who was off the clock picking up their own child. Staff responsible for this child were not aware they went inside. Video footage captured Child A walking down the hallway, stopping several times and looking around, eventually ending up near the cubbies. Child A's mother was at the cubbies, as it was pick up time, and noticed Child A was not accompanied by a staff member. Video footage indicates Child A was unattended for two (2) minutes. This is a serious violation.

On 05/01/2026 the program submitted a self-report to the Child Development Division. The program reported that three (3) year old, Child B, was left alone on the playground for approximately two (2) minutes. Video footage captures two (2) staff members and eleven (11) children standing at the door that enters the building from the playground. Staff were not aware that as they entered the building that Child B walked back to the sandbox. While the staff members are observed walking the children to the Ladybug/Spider classroom, it does not appear that staff counted how many children they had in their group. Meanwhile, video footage on the playground captured Child B playing in the sandbox. Child B leaves the sandbox, walks to the door, and attempts to open it multiple times. When they are not able to, they started to cry. The program's nutritionist opens the door and is seen letting Child B into the building. Child B was unattended on the playground for two (2) minutes. In an interview the Director at the time of the incident, Dayle Sargeant, stated that Child B appeared upset and cried for several minutes after coming inside. When the Director returned Child B to the Ladybug/Spider classroom staff were not aware Child B was not in the classroom. This is a serious violation.

5.1.1 · The licensee shall ensure that the CBCCPP environment and practices support children's health and safety.
Infomation was gathered during the investigation that confirmed the Director and program staff advised program leadership of ongoing concerns within the Ladybug/Spider classroom to onclude maintaining children's safety, staff stress and strain and the impact on children, as well as program wide issues with adequately staffing classrooms. These concerns were confirmed to be shared prior to the two (2) self-reported serious violations and one (1) self-reported substantial injury to a child that allegedly was not observed by staff. In an email dated 04/02/2026, Dayle Sargeant informed Robert Riley that she had been left out of ratio for twenty (20) minutes and staffing issues in the mornings has led to ratio non compliance for two (2) to five (5) minutes in multiple classrooms. In an email dated 04/05/2026 the staff's union sent a letter to the leadership team, sharing their concerns with the opening of the Butterfly classroom, which would substantially increase enrollment. They asked leadership to pause on opening the new room until more staff and a qualfied teacher associate is hired. During an interview, a staff member stated that they worked in the Ladybug/Spider classroom and requested a transfer due to the behavioral support that was required and not provided in that classroom. Evidence indicates that leadership did not adequately respond to these concerns which may have changed the outcome of staff burnout, treatment of children, operating out of ratio, and lack of supervision which resulted in an injury and two(2) seperate occasions where children were unaccounted for. During my licensing visits I observed Robert Riley and Rebecca McHale in the Ladybug/Spider classroom while children were engaging in dangerous behaviors described in the violation for regulation 6.2.6.5

6.2.6.5 · Children shall be protected from the harmful acts of other children.
During a ninety (90) minute visit in the Ladybug/Spider preschool classroom this licensor observed the following. Children hitting, kicking, pushing, pulling hair, and throwing toys at each other. Often staff were unaware of these behaviors as the room was so chaotic they were unable to address each incident as they occurred.

6.2.5.2 · Staff shall appropriately hold, touch, smile and talk to children.
The following two (2) incidents were observed on video footage recorded in the hallway outside of the Ladybug/Spider classroom. Both incidents occurred on 04/30/2026. Incident one (1): Child C is observed laying on the hallway floor. It appears Staff X asks them to get up. When Child C does not respond, Staff X picks Child C up by the ankles and carries them down the hallway. Child C was upside down, head facing the floor, arms hanging loose. Incident two (2): During a transition from the playground to the classroom, Staff Y is observed holding onto one of Child D's wrists and pulling him along as the group walks towards the classroom. Child D lost their balance and fell to the floor. Staff Y does not help Child D up and instead drags Child D who is on their knees, by their arm. This is a serious violation.

On 04/30/2026 the program self-reported that Child F fell from a playground structure, located at Battery Park, the fall resulted in a leg bone fracture, which required a cast. Staff stated that Child F fell in the gap between the platform and ladder. This licensor inspected the structure and observed a sticker on it that stated it is designed for use by children ages two (2) to five (5) years old under direct adult supervision. Child F is seventeen (17) months old and was not permitted to use this structure based on their age. Additionally, the supervision being provided did not meet requirements even for children ages two (2) to five (5) years of age as supervision was only provided at the base of the slide and not near the ladder where the child fell.

5.10.1.1 · General Safety: The licensee shall ensure the physical facilities of the CBCCPP, grounds, equipment, and toys present no hazard to the health, safety, and well-being of the children.
The following hazards were noted in the Ladybug/Spiders preschool classroom, where Child D was injured. Children were allowed to climb up onto window sills that are three (3) feet above the floor. During the 05/06/2026 licensing visit, this licensor observered, three (3) children on the window sill pushing each other and banging on the window. There were multiple loose electrical cords. A child was able to pull a door handle off of the classroom door and proceeded to throw it across the classroom.

6.2.1.3 · The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
Eight (8) staff members reported to this licensor that their classroom has not maintained staff/child ratios on multiple occasions. The former Director, Dayle Sargeant, forwarded this licensor, an email sent to leadership member Robert Riley(Dayle's supervisor) on 04/02/2026, informing him that she was left out of staff/child ratio for twenty (20) minutes and there have been other occasions where classrooms were out of ratio for two (2) to five (5) minutes. In this email she shares her concerns that the program is operating out of compliance with licensing requirements. This is a serious violation.

During an interview with Staff W, they stated that while they were working in the Ladybug/Spider(preschool) classroom, Child C and Child E were located alone in the classroom bathroom. They had not seen them enter the bathroom but at some point, after they entered, Staff W realized they were not in the classroom. When Staff W went to the bathroom door, they were unable to open it but could here Child C and E laughing. Staff W pushed hard on the door and it slowly opened. Child C and E had placed items in front of the door, making it hard to open. Once the door was opened Staff W noticed that both children had their pants off. This is a serious violation.

3.2.5 · Self-reported violations: If an incident or situation occurs in a CBCCPP while children are present that could be considered a serious violation as defined in the rule 2.2.50 of these regulations, the licensee has a responsibility to self-report this to the Division within twenty-four (24) hours of the incident. A complete report will include a description of the incident, what the licensee has done to verify the particulars of what occurred, and how the licensee has taken corrective action to ensure the safety and well-being of children and to prevent a future serious violation. If such a report is received in a timely manner from a licensee with a history of consistent regulatory compliance, no child has been seriously injured or harmed as a result of the incident or situation, and the licensee has taken prompt and appropriate corrective action; the Division may, on a case by case basis and at the Division's discretion, elect to issue a warning, rather than a violation related to that incident or situation.
Two (2) incidents occurred at the program that required the submission of a self-report to the Child Development Division however reports were not submitted. Incident one (1) two children were located unattended in a bathroom, the staff member was not aware they were in there or for how long they had been. Incident two (2) the Director, Dayle Sargeant, was out of ratio staff/child for twenty (20) minutes. These incidents are considered a serious violation, and the program did not submit a self-report to the Child Development Division as required by this regulation.

6.2.1.3 · The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.
Information gathered during interviews with staff in the Grasshopper and Cricket classroom indicate that on several occasions they combined their classrooms while inside due to staffing challenges. Both classrooms serve children ages twelve (12) months to twenty-four (24) months old. The maximum group size for this age group is ten (10); the staff members stated their group size exceeded ten (10) when the classrooms combined. Furthermore, staff stated they were unaware that when classrooms combine, attendance in the Brightwheel app must be updated to reflect which classroom the child was in and which staff were providing care. Review of the spreadsheets provided by program leadership during this investigation support that when groups combined it was not documented. Groups may combine inside for special activities, naptime or if the room is divided and the separation of the groups is easily defined. This is a serious violation.

7.1.2.2 · Staff who are counted in the staff/child ratios and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations shall obtain training in pediatric first aid and in infant and child CPR within three (3) months of beginning work in the CBCCPP and remain currently certified.

7.1.3 · The licensee, in consultation with the program director, shall establish written program policies and procedures and provide these to staff and to auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations during an orientation training session approved by the Division prior to being left alone with children. Trainees under eighteen (18) years of age and other staff not left alone with children shall complete the orientation training within at least one (1) month of their first date of working with children. Complete written information and the orientation training session shall include: Basic knowledge of child growth and development; Routine and emergency health protection of children including health related exclusions; Safety and sanitation requirements including handling and storage of hazardous materials and disposal of bio contaminants; Positive behavior management; Supervision of children; Child accident and injury procedures including building and physical premises safety; Safe sleep practices; Administration of medication requirements; Emergency and evacuation requirements; Nutrition and food safety including prevention of and response to emergencies due to food and allergic reactions; Recordkeeping; Transportation and child passenger safety; Release of children; Respectful engagement of families; Preventing, recognizing, and reporting child abuse and neglect; including information about the signs and symptoms of sexual abuse, sexual violence, grooming processes, recognizing the dangers of child sexual abuse, and other predatory behaviors of sex offenders; Recognition of and response to the symptoms of common childhood illnesses; Preventing the spread of infectious disease; Providing developmentally appropriate activities and experiences for children; Inclusion of children with special needs; Guidelines for volunteers, partner staff, auxiliary staff, and business managers; Responsibility to comply with current applicable licensing regulations; Staffing requirements to include opening and closing; and Ensuring children have extra clothes and diapers available.

7.3.1.4 · The program director of a CBCCPP licensed to care for sixty (60) or more children shall be qualified as a teacher, shall have at least an additional twenty-four (24) months of experience working with groups of children from grade three (3) or younger, and shall have completed either: * A Vermont Early Childhood and Afterschool Program Director Step Two (2) Certificate or Vermont Early Childhood and Afterschool Program Director Credential, Step Three (3); or * Successful completion of a three (3) college credit course in curriculum, and an additional nine (9) college credits in program management, staff supervision, administration, or human resource management.
The program director is missing two (2) credits required to be qualified. A variance application was received and denied because the program did not provide documentation of fingerprinting and/or documentation of having sent child abuse and neglect registry check paperwork to the Division for several staff.
