5.40 · Before the expiration date on the card, training for First Aid and CPR shall be validated by the American Red Cross, American Heart Association or other equivalent, state- recognized organization, and the specific certification documentation maintained in the appropriate Afterschool Child Care Program Staff file.

5.14 · The licensee shall ensure that no person shall be left alone with children without approval from the Division which shall be based on the results of the background check to include fingerprinting.
Staff person B has worked as a substitute in the program since September 2024. Staff schedules kept on site and statements of staff persons present indicate Staff person A was present for all or a portion of a program day an average of two (2) to three (3) times a month minimum. The two staff present during this visit confirmed that in the times they each worked with Staff person B, this person had been left alone with children during transitions and/or for planned activities.

18.77 · Within six months of the initial date of employment, Staff working with children and the Site Director and/or Program Administrator shall maintain an up-to-date BFIS Quality and Credential Account. Documentation, verification of qualifications and all annual professional development activities as specified in the rules in Section 5 of these regulations shall be submitted to NLCDC to be verified and maintained in BFIS.

13.14 · The tops of tables used for eating snacks or meals or other surfaces coming into contact with food shall be washed and sanitized prior to eating.
Children were served snack upon paper towels that were placed upon the art tables that had not been cleaned. There was visible streaks of smeared clay water, patches of paint, and other art supply materials upon the table surfaces. Many children's paper towels were wet from the juice of the fruit served for snack and the wet mark was visible on the table when the paper towel was removed
