6.2.7.5 · No punitive action shall be taken with children for not going to sleep, for toileting accidents, for failure to eat all or part of a meal or for failure to complete a prescribed activity.
On 09/02/2025 the program contacted the Child Development Division to report that they have a video recording of a staff member roughly handling a child. The video captured Staff A repeatedly telling Child X to sit in their seat and to stop bothering the other children sitting at the table. Staff A can be seen adjusting Child X's body in the chair three(3) times in an attempt to get them to sit straight in their chair. When Child X stands up and reaches across the table towards another child, Staff A is seen pulling Child X up out of their chair with a hand on each of the child's wrists. Staff A then moved Child X by lifting them by the arms and roughly placing them down in a different chair. Child X can be seen holding her wrist and crying. In an interview Staff B shared that she could see that Staff A had a stong grip on the child's wrist. Staff B noticed there was a red mark on the child, took a picture and reported it to the program director. After reviewing the video the director notified the child's family and met with Staff A. The program terminated Staff A during that meeting.

5.10.3.1.6 · The outdoor play area shall be free of dumpsters, uncovered trash cans, highly flammable materials, standing pools of water and other hazards. Staff shall inspect the outdoor play area before children begin to play to make sure there are no hazards present such as, but not limited to, animal feces, litter, adult tools, or other items that might injure a child.
During the inspection of the playground I observed a white picket from the playground fence, on the ground, with the sharp ends of the nails pointing upwards. This picket was in the grass in an area where children were running and playing. The nails could have caused significant injury if a child stepped on them or fell on the picket.

5.10.3.1.5 · Fencing installed after the effective date of these regulations shall: * Be a minimum of four (4) feet in height with openings no larger than 3.5 inches; * Equipped with gates with self-closing and self-latching mechanisms; and * Include at least two (2) exits with one (1) that does not lead into the CBCCPP.
The gate nearest the parking lot has a gap under it that exceeds 3.5 inches. The gap under the gate was identified during a previous visit and the program was required to add material under the gate to close the gap. That material(crushed stone) has washed away and the gap has returned.

7.1.2.2 · Staff who are counted in the staff/child ratios and auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations shall obtain training in pediatric first aid and in infant and child CPR within three (3) months of beginning work in the CBCCPP and remain currently certified.

7.2.2 · The licensee shall ensure that all new staff and auxiliary staff, prior to working with children in the CBCCPP; and any new individual designated as the representative of the licensee shall submit a Records Check Authorization form to the Division and shall submit to fingerprinting at a location designated by the Division after having received the Fingerprinting Authorization Certificate by the Division.
Staff A and Staff B have not completed fingerprint supported background clearances. Staff A was required to submit to fingerprinting in June of 2023 and Staff B was required to submit to fingerprinting in May of 2023.

5.10.3.3 · Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.
The cushioning material under and around the playground structures no longer meets the requirements of this regulation. Grass was observed growing up through the cushioning material, most of the cushioning material(bark mulch) has broken down, is compacted and does not meet depth requirements. The director stated they were aware of the conditions and had already placed an order for new bark mulch.

6.2.6.1 · Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.
During the transition from free play to rest time in the Pre-K 4 classroom, Staff A allowed Child X and Child Y to leave the classroom and go to the bathroom, located in the hallway, there were no staff present supervising them in the bathroom. Staff C was helping children on the other side of the classroom and it did not appear that she saw Staff A send the children out of the classroom. After 5 minutes went by, this licensor left the classroom and proceeded to the bathroom. As I was walking down the hall Child X and Y came out of the bathroom and went back into the classroom. As they were opening the classroom door this licensor heard Staff C tell them that they can not go into the hall alone.

3.4.7.5 · The licensee shall maintain a current list of the licensee or designee, staff, auxiliary staff, and volunteers as in the rules in section 7.7.5 of these regulations, as applicable in BFIS. Any changes shall be reported through BFIS within five (5) working days of the change.

5.6.6 · All non-prescription medication administered by staff shall be labeled with the child's name and be in its original container with directions for its administration. It must be administered prior to the expiration date on the container. Any deviations from the label's instructions shall be in writing from the child's health care provider.

7.1.3 · The licensee, in consultation with the program director, shall establish written program policies and procedures and provide these to staff and to auxiliary staff left alone with children and/or counted in staff/child ratio as specified in the rule 6.2.1.8 of these regulations during an orientation training session approved by the Division prior to being left alone with children. 6.2.5.4 · Staff shall be available and responsive to children, encouraging them to share experiences, ideas, and feelings.
During an approximately 45 minute visit ,by this licensor, the following was observed in the Toddler 2/3 classroom. Staff A and Staff B appeared not notice the following and therefore did not intervene. A sippy cup of what appeared to be apple juice was on the floor, a child drank from the cup and then threw it back on the floor. The cup remained on the floor until another child picked it up and walked away with it. Eventually, it was picked up and moved out of the childrens reach. Children were allowed to play with squirt bottles containing water. I observed children spray and wipe toys with a cloth. Children were not directly supervised and were squirting multiple surfaces througout the classroom. At one point a child sprayed another child's art work causing the child to get upset. After several minutes Staff B consoled that child and asked if she could cut off the wet part.Another child appeared upset at a friend and squirted them. Two children were seen fighting over one of the cleaning cloths. One child put the cloth in their mouth and the other child began pulling. The struggle over the cloth ended when the child pulled hard enough that the cloth was ripped out of the other child's mouth. I was sitting about 10 feet away and could hear the child's teeth clack together. Staff A and B were not sitting at the table where children were coloring, A child picked up a piece of crayon that was approximately 2 inches in length and put it in his mouth. He then ran across the room to the window. This was a choking hazard, after 30 seconds I realized staff still did not realize the crayon was in his mouth, at that point I notified Staff B. Staff B was able to get the crayon out of his mouth. Lastly a child was walking around with no shoes on. Staff A approached and told the child that it is a school policy to wear shoes in the building. The child moved away from Staff A and Staff A followed. Staff A was eventually able to get the child into their lap. The child was screaming and crying as Staff A tried to get the shoes on while repeating to the child that shoes on is a rule. Eventually the child ran from Staff A and hid between the wall and the refrigerator. Staff A was observed using their phone to text for help with the child. Staff A appeared frustrated, after putting their phone down Staff A went and sat on the carpet. For approximately 5 minutes Staff A sat on the carpet and was not seen speaking with or engaging with children in the classroom. In the meantine Staff C arrived and took the child who would not put their shoes on out of the classroom. The visit ended shortly after that child left the room with Staff C. Staff A and B were observed interacting with children but were not actively supervising the group as a whole which led to the observations reflected in this report.When challenging behaviors arose staff were seen telling the child not to do something but were not seen redirecting or speaking with them about the challenging behavior. Staff A was not responsive to any of the children after being unable to get the child to put on their shoes. Although Staff A called for support, Staff A should have asked to take a break from the group to regain composure in order to ensure they could meet the needs of the children in their care. Furthermore, Staff A and Staff B should have been supervising 2/3 year old when using small crayons and squirt bottles.
