8VAC20-780-160-A · Each staff member and individual from an independent contractor shall submit documentation of a negative tuberculosis screening. Documentation of the screening shall be submitted at the time of employment and prior to coming into contact with children. Staff #1, #2, #3, #4 and #5 have been working with children and do not have documentation of obtaining a TB screening. Staff #1 has been working for more than 3 months, Staff #2 has been employed for more than one month, Staff #3 employed for approximately 3 months and Staff #4 and Staff#5 have been employed for more two months.

or shaking a child. On 6-26-2025, Staff #1 popped Child #1 with their open hand on the right part of their head near their eye. Child #1 immediately put their hands up to their face where they were struck.

The center failed to ensure when staff are supervising children, they shall always ensure their care, protection, and guidance. Center staff confirmed that on 2-3-2025, Child #1 was fed a mixture of bananas and breast milk that belonged to Child #2.

8VAC20-780-400-A · Center did not ensure that in order to promote a child's physical, intellectual, emotional, and social well-being and growth, staff shall interact with the child and one another to provide needed help, comfort, support. Video footage shows that on January 9, 2025 in Room #1, Staff #1 was observed walking past Child #1 who fell face forward while strapped into a rocker seat. Child #1, with the rocker attached to them crawled over to a group of children who were being fed by Staff #2. Staff #1 did not provide support until approximately 90 seconds later.

8VAC20-780-40-E · Based on center documentation and staff interviews, the licensee did not ensure, the operational responsibilities of the licensee shall include ensuring the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

Evidence: Staff #1 and Staff #2 did not follow the center's supervision policy and procedures to include "Never leave a child unattended." and "Staff members must be able to see and hear the children in their care and be readily available for (potential) emergencies at all times." Child #1 was left alone on the playground for approximately 30 minutes on July 2, 2024.

8VAC20-780-270-A · Based on observation and staff interviews, the provider did not ensure that all areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin.

Evidence: On the "older children's" playground there was section of the chain linked fence that has 3 metal clips that are broken, sharp and accessible to children.
