Evidence: the record for staff #1, (date of hire: 10/18/23) who indicated that they have lived out of the state of Virginia in the past five years, had no documentation of an out of state central registry search or a criminal history name check.

8VAC20-780-410-1 · Based on multiple interviews, and a review of documentation, it was determined that staff used a forbidden action of roughly handling a child and restricting movement. Evidence: Interviews revealed that on 10/24/2023, in the toddler classroom, between approximately 11:00 - 11:30am, Staff #1 was observed "forcefully" trying to get child #1 (19 months old) to lay quietly on their cot to nap. First, Staff #1 attempted to keep child #1 still by placing their hand/arm on the child's back and then by pushing the child's head down towards the cot. Then staff #1 was observed changing the child's position on the cot by roughly picking them up and switching the child's head/feet location to the opposite side. It was reported that Child #1 was crying before, during and after this incident.

8VAC20-780-80-B-2 · Based on review of documentation and interview, the facility failed to inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the facility and requires outside medical attention. Evidence: On 6/5/2023, between approximately 5:00-5:30pm, child #1, age five, sustained a head injury outside on the playground. The child was taken by the parent to the emergency room on 6/6/23 and was diagnosed with a concussion. The parent informed the center director, who then completed a report for the company, but the facility did not report this injury to the department.
