Areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; protruding nails, bolts or other components that could entangle clothing or snag skin. On the back deck ,leading to the playground, there were several nails, hammered incorrectly through the deck, exposing the sharp points through the wood and within reach of the children. On the outside playground, three huge plastic puzzle pieces were split with cracks and broken around the edges. A brown and tan kitchen playset had broken handles on the cabinets and stovetop. In Classroom A there was peeling laminate paper on the cupboard drawers and cabinet door, chipping and splintered wood on the half-door that leads to the bathroom. In Classroom C there was cracked and chipping plaster around the bottom of door, and around the window and the wall below the window. In the Main Entry there was chipping plaster on the wall, a crack in the plaster that ran the length of the wall, and the boarders of the floor were dirty and unclean at the front door.

Pathway off backyard deck leading to the playground, had cement tiles surrounded by a plastic enclosure that was lifting and no longer in tact, presenting as a trip hazard. On the outside playground, four scooters and two tricycles, made of metal with red pads, had chipped paint and rust on the handlebars, and two of the tricycles also had broken seats. One horse seesaw was cracked on the front seating and a turquoise foot-car was cracked on the seat.

Evidence: 1. Broken floor tiles and split flooring was observed throughout the school-age classroom. Tape was used previously to conceal the damaged flooring. The tape was broken, exposing tripping hazards. 2. Damaged vents were observed in the School-age Classroom and the Two-Year-Old Classroom. The vents were bent and lifting from the floor surface. 3. In the Pre-School Classroom there was chipping paint along the windowsills and along the wall. 4.On the outside playground, metal fencing surrounding the perimeters had several areas of untwisting wiring, resulting in an unraveling-spoke; a broken panel on the wooden fence; nails were loose and lifting on the wooden fence. 5. On the outside porch, there was a broken table, accessible to the children outside the Preschool and School-age Classrooms.

Evidence: 1. There are three vinyl floor tiles missing in the preschool classroom near the rear door. The missing floor tiles pose a risk of tripping and expose the subfloor that had small pieces that was jagged along the edges. An additional floor tile in the middle of the room was split and missing a piece of the tile. 2. The wall under the window in the preschool classroom was cracked exposing the drywall and a nail head. The wall also had peeling paint. 3. The window seal in the school age classroom was cracked exposing the drywall and a nail head. 4. The landscape edging around the concrete pad near the steps of the porch was cracked and protruding upward from the ground posing a tripping hazard. 5. The preschool bathroom had four holes in the drywall near the toilet.
