Evidence: 1. Staff #3 (date of hire 10/02/2023) was present at the center and confirmed they started working with children approximately 2 weeks after school started in September. Staff #2 did not have documentation that the criminal checks were completed in their file prior to the date of hire. Staff #2 has a background check for Virginia dated on 10/18/2023, which is after the first day of employment. 2. Staff # confirmed that Staff #3 was a new hire and has been working with children since the second week of school.

22.1-289.035-B-4 · Based on record review and interview, it was determined that the center did not ensure to obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.

Evidence: 1. Staff #2 confirmed on their Sworn Statement (signed on 03/05/2023) that they lived in three states outside of Virginia in the past 5 years and no background checks were completed in those three states prior to employment. 2. Staff #3 confirmed on their Sworn Statement (signed on 10/28/2021) that they lived in a state outside of Virginia in the past 5 years and no background checks were completed for that state prior to employment and working with children in care. 3. Staff #1 confirmed that there were no out of state background checks completed for Staff #2 and Staff #3.
