center's activities, services, and facilities are maintained in compliance with these standards and the terms of the current license issued by the department. The terms of the center?s license include a stipulation that reads ?Only in classrooms #4 and #5 may children under 2 ? years of age be provided care.? The stipulation is to ensure the center is in compliance with the certificate of occupancy issued by the City, which says children under 2 ? are to be cared for in a room with direct egress. The center had a divider that split room #4 into a separate infant and toddler room, resulting in no direct egress in the toddler room. Technical assistance was provided to the center on 01/21/2025 regarding the direct egress requirement.

Evidence: On 08/17/2023, a 2 year-old child #1 took a 1 fluid ounce bottle of infant of acetaminophen from another child's diaper bag without staff #1 or #2's awareness. Staff #1 had taken child #1 and 3 other children to the hallway to retrieve milk from the kitchen. While in the hallway, Staff #1 reported she saw child #1 with the open bottle of acetaminophen to her mouth. Staff were not able to confirm if the child had ingested the medication.

Evidence: 1. On 07/19/2023, Staff #1 roughly handled a 2 year-old Child #1 during nap because she would not nap. a). It was reported by staff witness at approximately 12:00pm when child #1 got off of her cot, Staff #1 grabbed child #1 by one arm and one leg and "slammed her on her cot," and Child #1 "cried louder." c.) An infant staff heard crying coming from the twos classroom and came over to see if they needed help. When the infant staff entered the classroom, she reported Staff #1 "snatch the child by her arm and threw the child on the cot." It was also reported Staff #1 proceeded to pat Child #1 on the back hard. 2. On 07/12/2023 during nap a staff witness reported Staff #1 grab child #2 by the arm and "forcefully push him down on his cot" and began "aggressively patting him on the back." Staff #1 was also seen and heard yelling in the face of children that did not nap.

The center's supervision policy requires staff to perform and document on a "Child Supervision Record (CSR), that they did a face-to-name check of each child in their care every 30 minutes and/or during any large class transitions. 2. On 05/23/2023 the center did not follow their own policy when staff #1 and #2 did not document having done any face-to-name checks for child #1 who entered the Discovery Preschool classroom at 4:35pm. As a result, Child #1 was left unsupervised on the playground for approximately 10 minutes between 5:00pm-5:10pm.
