8VAC20-780-40-E · Based on observation and interview, it was determined that the center did not ensure that the operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

Evidence: 1. The preschool class was observed to transition from the outdoor play area back to their classroom. There were eight (8) children observed coming out of the playground area in which the stipulation to the center?s license is that there shall be no more than six (6) children may be in the outdoor playarea at any time. 2. Staff #1, the owner, confirmed that there were 8 children on the playground and confirmed that the stipulation to the center?s license is that there is only to be 6 children at any time to the outdoor playarea.

8VAC20-780-270-A · Based on observation and interview, it was determined that the center did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a safe and operable condition. Evidence:

1. In the preschool room and in front of the children?s bathroom, the carpet was tearing and shredding from the floor which poses as a tripping hazard to the children in care. 2. A section of the baseboards in the infant room are peeling off the wall in reach of children in care. This poses as an injury and pinching hazard to the infants in care. 3. In the toddler room, there was a broken plastic push toy that was cracked which poses as a pinching hazard to children in care. 4. There is a white wired shelf in the play area of the future waddler?s room which is a tipping hazard; it is not stable against the wall and can easily fall on children in care. 5. There were several individual loose staples in the front walkway of the entrance and to the hallway to the toddler?s room. This poses as injury hazards to children in care.

Evidence: 1. Child #1 does not have documentation of immunization. The parents have stated that it is their religious practice for no immunizations. There is no signed affidavit to the center or documentation of immunizing agents conflicts with religious tenets or practices. 2. Staff #1 confirmed that Child #1 does not have documentation of immunization to their record nor do they have the required signed affidavit to the center regarding their religious exemption.
