22VAC40-185-340-A · Based on interviews and photographs, the licensee failed to ensure the care, protection and guidance of a child in care.
Evidence: 1. Staff #1 reported that between the hours of 9:30 a.m. and 10:00 a.m. on April 19, 2021, she took 4 toddlers out to the playground. Staff #1 reported they exited the classroom door that led directly to the fenced play area. Staff #1 stated that she checked the gate latch to ensure it was engaged, per staff #3?s instruction. Multiple staff interviews established that the exit gate on the playground is ?difficult to latch? securely because the latch is loose and interviews as well as photographs confirm that the gate has a gradually increasing ?gap? toward the bottom of the gate. 2. Both staff #1 and staff #2 visually scanned the play area and did not see child #1 (a 20 month old toddler). Staff #2 confirmed via radio that child #1 had not gone back into his classroom, then called the front office to report that a child was missing and immediately ran down the walkway leading from the playground gate, along the side of the center, toward the parking lot. 3. Staff #4 confirmed that she received a radio call to the front office stating that a child was missing and that she instantly ran out toward the parking lot where she saw a member of the public waving her hands and holding child #1. Staff #2 stated that the individual?s car was pulled into the lot with the door still ajar and the turn signal still blinking. Staff #4 stated that child #1 reached for her as she approached but did not appear to be upset. 4. The center?s parking lot is located adjacent to a divided highway with two lanes of travel in each direction and a speed limit of 55 MPH.

Based on observation and interview. the licensee did not ensure that documents required by the Superintendent were posted in a conspicuous place on the licensed premises. Evidence: The most recently issued violation notice from the previous inspection was not posted conspicuously in the center. The violation notice was located under the Summary page of the Inspection Report and the entire Inspection Report was closed behind a glass display window. The violation notice was not visible. Staff confirmed during the inspection that the violation notice was not visible at the time of the inspection.

Based on interviews and a review of written policies and procedures, the licensee did not always ensure that the center's activities, services, and facilities were maintained in compliance with the Standards for Licensed Child Day Centers and the center's own policies and procedures that are required by these standards. Evidence: 1. On the afternoon of 6/14/2023, 2 two-year old children were left alone and unsupervised on the playground when staff failed to follow the center?s own written playground safety polices. 2. The center?s written ?SOP for Outside Play? states that ?Staff must complete a name to face every 15 minutes during outside play. Staff must check off children and write the time on the name to face sheet?. 3. When asked if a ?name to face? check was conducted using the written list of children?s names to confirm that all the children were accounted for, staff #1, staff #2 and staff #3 confirmed that they did not call individual children?s names from their name to face sheet and that they did not use that list to look for each individual child. Each of the three staff confirmed that they only counted the total number of children present on the playground and again as they entered the building. 4. The program?s written playground plan states that ?Staff must ensure that any children that join their group are added to the name to face sheet and to their classroom app at all times?. a. Two of the 3 staff caring for child #1 and child #2 on the afternoon of 6/14/2023 recalled that 6 children from their group were taken to the ?pre-tod?s? classroom. The third staff recalled that 2 or 3 children went to the ?pre-tod?s? classroom. b. The ?pre-tod?s name to face sheet did not contain the names of any of the children brought to this room on the afternoon of 6/14/2023, nor did the two and three year old name to face sheets reflect that some children left this group and went to the Pre-tods? classroom on 6/14/2023. c. The final remaining staff present on 6/14/2023 in the front room, where child #1 and child #2 are normally cared for in the afternoon, stated ?I did not know the children were missing until their parents arrived - I thought they were in Tod?s?. 5. The program?s written playground plan states that "There is to be no more than 1 class on the playground? at a time?? Interviews with staff #1, staff #2, and staff #3 confirm that the two-year-old group and the 3- to 4-year-old group were both outside on the large playground at the same time on the afternoon of 6/14/2023. 6. Administrative Staff #5 stated that Staff #1 and Staff #2 ?broke policy?they combined classes and went outside. We do not allow 2 classes on the playground at one time. They did not keep track of these two [children]. They did not complete the required record keeping and they did not follow sight and sound supervision.?

8VAC20-780-270-A · Based on interviews, the licensee did not always ensure that areas and equipment, inside and outside, are always maintained in a clean, safe, operable condition.
Evidence: Seven staff were interviewed regarding a concern about cleanliness resulting from the toilet not being flushed after each use by children. Two staff stated that they did not always flush the toilet between uses when assisting several young children toileting in succession, as long as the children only urinated. An additional staff acknowledged an awareness that another staff utilizes that practice.

8VAC20-780-500-B · Based on documentation and interviews, staff did not always ensure that children are cleaned and changed immediately when their clothes or diaper are wet or soiled.
Evidence: The digital program that staff utilize for documenting children's feedings, diaper changes, activities and important information throughout the day showed that:on 5/23/2023, child #1 arrived at the center at 8:50 a.m. Child #1's wet diaper was changed at 9:50 and again at 11:50. Child #1 had a bottle, took a nap and had an afternoon snack between 1:15 p.m. and 3:46 pm and at 4:48 child #1 was signed out and left the center for the day. Nearly 5 hours had passed since child #1's diaper had been changed when she was picked up from care. Child #1's diaper was reportedly very wet at the time that she left the center to go home.
