Staff #1 did not escalate concerns regarding Child B's ( 1 year 5 months old) behavior to the center director and regional management as needed based on concerns per policy. 3. Staff #1 did not create a written plan in place for Child A's repeat occurrences of scratching other children. The scratching incidents occurred on 9/11/2023, 10/11/2023, 11/21/2023. 4. Staff #1 signed acknowledgement of the Employee Handbook on 6/2022.

Evidence: 1. The center?s Continuity of Care policy for Infant Toddler Care Assignments states ? each caregiver shall be assigned up to 4 infants or up to 5 toddlers. These children once assigned, shall remain in the care of that caregiver until the child transitions to the next group. 2. Staff confirmed that the center moved children on a regular basis in Toddler A and Toddler B classrooms due to staffing. 3. The center failed to follow their own Behavior Guidance policy that states "Discipline will be constructive in nature and include the following techniques: Using limits that are fair, consistently applied, and appropriate and understandable for the child?s level. 4. Staff confirmed that seatbelts on toddler chairs were used to make sure the children would sit during circle time in The Toddler B classroom. 5. Staff #1?s statement confirmed that a child was ?plucked? on the stomach.
