Based on a review of records and interview, the licensee did not always obtain, for every applicable employee, a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years. Evidence: Ten staff records were reviewed. The record for staff #1, whose date of hire was documented as 9/27/2023, contained a Sworn Disclosure Statement which indicated that employee #1 resided in the state of New York within the past 5 years. The record did not contain the results of a Abuse and Neglect Registry Search for the state of New York within 45 days of employment in the Child Day Center. The administrator present during the inspection confirmed that this documentation was not in the record for staff #1. The record for staff #7, whose date of hire was documented as 9/25/2023, contained a Sworn Disclosure Statement which indicated that employee #7 resided in the state of Texas within the past 5 years. The record did not contain the results of a Criminal Record Search for the state of Texas prior to employment in the Child Day Center. The administrator present during the inspection confirmed that this documentation was not in the record for staff #7.

22.1-289.035-B-4 · Based on staff records and interview, the center did not ensure to obtain a copy of the results of a criminal history record check and a search of the child abuse and neglect registry from any state in which the individual has resided in the preceding five years.
Evidence: In Staff#3's record (date of hire: 09/01/22) there was no results of a central registry finding for the state of GA. In Staff#4's record (date of hire: 08/23/21) there was no results of a criminal and central registry findings for the state of TX. Interview with staff confirmed the out of state results were not available for review during the inspection.

8VAC20-770-60-C-2 · Based on a review of records and interview, the licensee did not ensure that results of a search of the central registry are obtained for each employee within 30 days of employment.
Evidence: Seven staff records were reviewed. The record for staff #6 documented the start of employment as 9/1/2022. The central registry findings were dated 12/12/2022. Documentation shows that a second request was sent on 11/16/2022, which is 76 days after the employee began employment.

8VAC20-780-420-A · Based on a review of written procedures and interviews, the program does not provide all of the required written procedures to parents before the child's first day of attending.
Evidence: 1. The written policies included in the current parent handbook do state that the custodial parent has a right to be admitted to the center, as required by the Code of Virginia 22.1-289.054. 2. The parent handbook states throughout , in several areas "Let your child walk independently into school carrying own belongings." ; "Students will be walked into the school building by staff members during drop off time." ; "Pull up to the drop off entrance of the building and please remain in your vehicle." ; and for late arriving students "ring the front doorbell; student will be escorted to class by office personnel". 3. The parent handbook states that Class room observations, using viewing windows, by reservation, are encouraged. However, it is noted that no observations will be scheduled during the month of September or "until children are settled into a routine and anxieties are dispelled". In addition, it states that "due to Covid-19 restrictions we will not have casual observations until further notice." 4. Interviews with the Program Director revealed that parents are not normally permitted in the classrooms without prior arrangement and are discouraged from entering the facility unless an appointment is made in advance to observe from the viewing window or to meet with staff.

22.1-289.035-B-4 · Based on a review pf documentation and interview, the licensee was unable to demonstrate that an Out of State Sex Offender Registry and an Out of State Criminal History Name Check were obtained for each state, other than Virginia, that any individual employee has resided in the past 5 years, prior to their 1st day of employment/service at the center.
Evidence:Four staff records were reviewed at the time of inspection on 3/1/2022. The record for staff #1 contained a Sworn Disclosure statement that indicated that staff #1 resided in Texas within 5 years of employment at the program. There were no results in the record for a Sex offender Registry search for the state of Texas. There were no results in the record for a Criminal Record Check for the state of Texas. The program director confirmed that these background checks had not been completed. Staff #1 was working in the center at the time of the inspection.
