8VAC20-780-40-E · (Systemic violation) The operational responsibilities of the licensee shall include ensuring that the center?s activities, services, and facilities are maintained in compliance with these standards, the center?s own policies and procedures that are required by these standards, and the terms of the current license issued by the department. The center did not follow its policy for active supervision and playground safety.
The supervision policy states, ?What is Active Supervision? Maintain sight and sound of all children at all times.? During the inspection, children were observed unsupervised on multiple occasions, including outside, in the gymnasium/cafeteria, in the hallway, and in the learning steps area. The center also did not follow its policy regarding playground safety, which states, ?Staff will remain active in their supervision of children during outdoor time, strategically placing themselves on the playground so they can see all children at all times.? At approximately 8:40 a.m., five boys were observed playing football in the field and two girls were observed checking in children as they arrived outside the back door of the gymnasium/cafeteria. No staff were present with the children at that time.

8VAC20-780-60-A-8 · Based on a review of records and interview, the licensee did not ensure that a written care plan is obtained for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction.
Evidence: The program's food allergy list contained the names of 12 children who were identified as having food allergies. Child #8 was listed as having a mild egg allergy. Staff stated that an allergy care plan had not been obtained for child #8 because exposure to the allergen does not require medication. Each child with an identified food allergy must have an allergy care plan from their physician, regardless of whether medication is the required response to an exposure.

Evidence: There was a container of powdered carpet and room deodorizer located on a surface at approximately 3 feet from floor level in the cafeteria where 39 children, ages 4 to 10 years old were being cared for during the inspection. The container was labeled "Keep out of reach of children" and had additional warnings to include "harmful if swallowed". Staff acknowledged that the substance was accessible to children.
