Evidence: The following was found during review of staff records: 1. The record for staff #1 (start date 10/17/2022) had documentation the individual had lived outside the state of Virginia within the past five years however there was not a completed criminal records checks prior to employment for one of the states noted. 2. The record for staff #3 (start date 11/28/2022) had documentation the individual had lived outside the state of Virginia within the past five years however there was not documentation that a search of the child abuse and neglect registry was submitted for that state within thirty days of beginning employment.

8VAC20-780-340-F · Based on observation and interview, facility did not ensure children are within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the restroom provided certain requirements are met.

Evidence: At approximately 4:20 pm, two school age children were observed not in sight and sound supervision of staff. One child was observed coming from the water fountain in an adjoining hallway and and another child was observed going to the restroom that was located two hallways from the program. Staff confirmed children, unless they are four years old, are allowed to go alone to the bathroom and to the water fountain. Staff confirmed they are not able to hear and see children from the cafeteria when they go to the water fountain and restroom. At least three adults were observed in the hallways that are not a part of the licensed program.
