8VAC20-780-340-A · When staff are supervising children, they shall always ensure their care, protection, and guidance.

On May 14, 2026, in the Two?s classroom, the center did not ensure care and protection of the children in care. There were 22 children (ages 2-3 years) present with three teachers; however, one teacher was in the bathroom diapering a child, and another teacher was seated at a table concluding an art project with four children. This left one teacher responsible for supervising 16 children in the carpet and kitchen area. As a result, children were observed climbing on furniture and hitting one another while the teacher attempted to manage the group by themself.

On 4/21/2026 while outside on the playground, Staff A inappropriately used physical contact to redirect Child A (Age 4) away from the window. Staff A used her hand to nudge the side of the child?s head approximately 2 to 3 times.

8VAC20-780-40-E · Centers shall be in compliance with the center's own policies and procedures required by these standards.

The center's policy is that teachers perform name-to-face checks on their Child Supervision Records to ensure children are accounted for during the day. Teachers must look at each child's face to verify they are checking the correct child on their list. Staff A did not look at the face of Child A before marking the child accounted for, therefore the child was left unsupervised in the classroom for approximately 5-7 minutes.

1. On 4/8/2025, Child A was instructed to go to the table, Child A yelled and refused telling staff ?NO?. Staff A was then seen grabbing Child A (age 5 years) roughly by their arm to pull them up. 2. On one occasion, Staff A called out to Child B who was running in the classroom. Staff A then pulled Child B by the ponytail to stop the child from running and lowered the child to sit next to them all while still pulling the child?s ponytail.

8VAC20-780-80-B · Based on interviews and a review of documentation, the center failed to inform the department?s representative of an injury to a child that occurred while the child was under the supervision of the center and required outside medical attention. Evidence: On 1/9/2024, child #2 sustained a "nursemaid" elbow injury that required medical attention. Staff confirmed that they did not complete the online IROMT form or notify the Department.

Evidence: The depth of the wood chips was measured in three spots around the center composite play structure on the preschool/school age playground. All three spots measured less than six inches in depth.

Evidence: The Licensing Inspector observed 10 containers of germicidal and disinfectant solution containers in the room identified as "Staff". The door to this room was unlocked.
