8VAC20-780-340-A · When staff are supervising children, they shall always ensure their care, protection, and guidance.
On May 14, 2026, in the Two?s classroom, the center did not ensure care and protection of the children in care. There were 22 children (ages 2-3 years) present with three teachers; however, one teacher was in the bathroom diapering a child, and another teacher was seated at a table concluding an art project with four children. This left one teacher responsible for supervising 16 children in the carpet and kitchen area. As a result, children were observed climbing on furniture and hitting one another while the teacher attempted to manage the group by themself.

On 4/21/2026 while outside on the playground, Staff A inappropriately used physical contact to redirect Child A (Age 4) away from the window. Staff A used her hand to nudge the side of the child?s head approximately 2 to 3 times.

The center's policy is that teachers perform name-to-face checks on their Child Supervision Records to ensure children are accounted for during the day. Teachers must look at each child's face to verify they are checking the correct child on their list. Staff A did not look at the face of Child A before marking the child accounted for, therefore the child was left unsupervised in the classroom for approximately 5-7 minutes.

On one occasion, Staff A called out to Child B who was running in the classroom. Staff A then pulled Child B by the ponytail to stop the child from running and lowered the child to sit next to them all while still pulling the child?s ponytail.
