Evidence: On 9/8/2021, between approximately 9:00 am - 12:00 noon, 1) staff #1 told toddlers to "shut up" multiple times when they were sitting in the feeding table fussing while waiting for snack; 2) staff #1 stated they didn't like to be near child #1 and called them "ugly", "dobby", "weird" and elf boy"; 3) staff #2 called child #1 "disgusting"

    8VAC20-780-340-A · Based on observations, interviews, and documentation review, the facility failed to ensure the care, protection, and guidance of children in care.

    Evidence: At approximately 8:00am on 7/22/2024 child #1, age 8, became agitated when asked to write sentences as a consequence of running in the classroom. Child #1 proceeded to walk out of the classroom, and stand near the front door of the center while staff tried to calm them down. Child #1 then walked out of the building, ran across a road (with a speed limit of 25mph,) and climbed up on top of a vehicle in a parking lot approximately 150 feet away, before staff were able to catch up and secure the child. Staff brought child #1 back to the center, and they remained outside for approximately 30-45 minutes while different staff attempted to calm child #1 down and deescalate the situation. Child #1 was reportedly hitting, spitting, kicking, growling and breathing heavy. Child #1 appeared to have calmed down, but then was able to bolt from the center and staff a second time, this time running approximately 450 feet towards and onto a road with a 40mph speed limit. Staff chased child #1 until they caught up and found child #1 standing in the middle of the five-lane undivided road.

    1) The playhouse has a cracked roof, which is sitting inside the playhouse 2) There is a broken tile in the bathroom which is a tripping hazard 3) There is a broken purple car with cracks and sharp plastic exposed 4) There is deteriorating wood on the picnic benches/tables, and wooden equipment 5) There are multiple pieces of wood along the bottom of the fence with protruding nails/screws 6) There is a broken glass door leading to the four?s classroom from the playground 7) There are multiple tree roots that are exposed causing a tripping hazard 8) There are multiple fence pickets that are cracked/broken; one fence picket is missing 9) In the infant classroom, there were four cribs with loose fitting sheets. Loose crib sheets are a suffocation hazard and increase the risk of sudden unexplained infant death.

    1) One side of the sidewalk has an approximate 10-12' drop off. Two children were observed tripping and falling as they walked off the sidewalk onto the playground area. Tricycles, scooters and riding cars were also observed nearly going off of the edge. 2) The playhouse has a cracked roof, which is a pinching hazard 3) There is a broken play car with sharp plastic exposed 4) There is a broken tile in the bathroom which is a tripping hazard 5) There is a broken purple car with cracks and sharp plastic exposed 6) There is deteriorating wood on the picnic benches/tables, and wooden equipment 7) There are broken tires, that are cracked and are pinching hazards, on the wood truck 8) There are multiple pieces of wood along the fence with exposed nails 9) There is exposed metal wire and three metal fence pole ends at the base of the tree near the sidewalk that are sharp and rusted 10) There is a broken glass door leading to the four's classroom from the playground 11) There are multiple tree roots that are exposed causing a tripping hazard 12) There is a crack in the basketball hoop stand causing a pinching hazard 13) There is broken wood on the fence in the small playground and areas with rusty old nails/screws exposed, poking through the fence 14) The fence by the small playground is a head entrapment hazard that is approximately 4" wide and 9" off of the ground
