Areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. All cribs in the Infant classrooms had visible dried dirt and drool on the pexiglass. In the Infant C classroom, the refrigerator handle was covered with visible dirt and grime. In the Toddler A classroom, one of two children's bathrooms had an inoperable light and the smell of sewer gas coming from the bathroom piping. In the Preschool 2 classroom, the baseboard on the left side of the classroom had chipped wood and peeling paint.

Evidence: On 5/21/24, the center did not maintain the required supervision ratio of 1 staff for every 4 children in the infant B room (ages 4 months ? 13 months). Records revealed and staff confirmed that there were only 2 staff members in the infant B classroom when a 9th infant was dropped off at approximately 7:39am, a 10th infant was dropped off at approximately 7:49am, an 11th infant was dropped off at approximately 8:12am, a 12th infant was dropped off at approximately 8:18am, and a 13th infant was dropped off at approximately 8:30am. At approximately 8:30, a staff member in the infant B classroom called a manager to the classroom and a manager and extra teacher joined the classroom at approximately 8:32am leaving the classroom outside of the required ratio for approximately 53 minutes.

Evidence: 1)Upon interview with staff, it was reported that Child #1 (age 4) refused to join the rest of the class for an activity on the rug. When the child refused, Staff #1 grabbed the child?s hand to guide them to the rug. In the process, the palm of the child?s hand became red and broken skin was noticed. 2)Upon pick up by the parent of Child #1, the child was crying, so the child?s parent asked their child what was wrong. Child #1 verbalized to the parent that Staff #1 had dug their fingernails into their hand. 3)Child #2 (age 5), who was present during the interaction, stated that Staff #1 had become upset with Child #1 and dug their fingernails into their hand when they weren?t listening. Child #2 stated that Child #1 cried when Staff #1 grabbed their hand.
