Based on a review of records, the exempt program did not ensure that, for each staff person, a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years is present in their record. Evidence: 10 staff records were reviewed. The record for staff #7, contained a Sworn Disclosure Statement dated 9/20/2022 that indicated that staff #7 resided in California within the previous five year period. The record for staff #7 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from California. The record for staff #9 contained a Sworn Disclosure Statement dated 8/22/2023 that indicated that staff #9 resided in Texas within the previous five year period. The record for staff #9 did not contain a sex offender registry check, and a criminal record from Texas. The record for staff #10, contained a Sworn Disclosure Statement dated 9/20/2022 that indicated that staff #10 resided in Georgia within the previous five year period. The record for staff #10 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from Georgia. The interim director was unable to locate these background check documents during the inspection and confirmed that they were not in the staff records.

63.2(17)-1716-A-4 · Based on a review of records and interview, the program director was not able to demonstrate that she ensured that each staff supervising children has been certified by a practicing physician or physician assistant to be free from any disability which would prevent him from caring for children under his supervision.

Evidence: Four staff records were reviewed. The records for staff #1 and staff #3, who were both hired in September 2021, did not contain a Staff Health Report from a physician or physician assistant stating that the staff is free from any disability which would prevent him from caring for children under his supervision. The Program Director stated that these staff have not yet been to a physician to have the form completed and signed.
