Staff did not use behavior management techniques that were constructive in improving behavior or resolving conflict with Child 1 (age 4 years). On multiple occasions, staff would direct Child 1 to deescalate in the bathroom, for up to 10 minutes, if the child began screaming or throwing a tantrum. On multiple occasions, Staff told Child 1 they were going to ?call the nurse?, knowing the child was fearful of medical staff, to get the child to behave.

EVIDENCE: Staff #1 did not follow the center's policy procedures for Level III medical emergencies. Child #1 (age 15 months old) sustained a serious injury requiring immediate medical attention. Per their policy, staff were required to call 911 immediately. Staff did not call 911. The child's parent arrived at the center and called 911 at approximately 11:30 AM.

Evidence: Licensing staff observed a red O Cedar mop that contained cleaning solution to the right of the toilet in the bathroom in Classroom H. No children were observed in the area but it was accessible to children.

8VAC20-780-410-1 · Based on interviews and review of documentation, the center failed to ensure that staff shall not use physical punishment or strike a child.
Evidence: On 11/08/2023, Staff 1 and Staff 2 both stated that Staff 3 took Child 1 (14 months old) to the bathroom and then heard a smack sound and Child 1 crying. No marks were noticed on Child 1. Staff 3 stated that they lightly tapped Child 1 on the hand.
