Evidence: The record for staff #1, date of employment 01/10/2024, contained a tuberculosis screening dated 02/27/2024. The tuberculosis screening was not conducted within 30 days prior to the date of employment.

22.1-289.035-B-4 · Based on a review of records and interview, the center did not ensure that results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry are obtained from any state in which the individual staff has resided in the preceding five years.

Evidence: 1. The record for staff #3 (hire date 9/11/2023), contained a sworn disclosure that indicated that staff #3 has lived outside of Virginia within the last 5 years. Staff #3?s record did not have documentation of an out of state sex offender registry check, and an out of state search of the child abuse and neglect registry. 2. An administrator stated that the state does not provide background checks.

8VAC20-780-500-A · Based on observation, the center did not ensure children?s hands are washed after diapering and toileting.

Evidence: Staff #1 was observed completing two diaper changes in the Twos and Threes classroom. Staff #1 placed the children on the floor without washing their hands.

8VAC20-790-600-D-1 · Based on review of staff records, the center failed to ensure that all staff had current certification in CPR.

Evidence: 1. Staff #2's CPR certification expired on 3/12/2023. 2. Administration verified that the CPR certification was expired.

22.1-289.035-A · Based on record review and interview, the center failed to ensure that all employees shall undergo background checks every five years.

Evidence: 1. The staff record for Staff #3 contained a national criminal background check dated 5/17/2018. Staff #2 should have undergone a criminal background check on or before 5/17/2023. 2. The director verified that a criminal background check had not been completed for staff #2.
