If a child needs to be excluded according to subsection A of this section, the following shall apply: 1. Arrangements shall be made for the child to leave the center as soon as possible after the signs or symptoms are noticed; and 2. The child shall remain in the designated quiet area until leaving the center. On or around March 3, 2026, Child #1, age 2, recurrently vomited in the classroom. Child #1 was kept in the classroom with 8 additional children for approximately one hour before being brought to the center's designated quiet area to await pickup.

Staff #2, employed for 4 months, did not have documentation of requesting a criminal history from one state. Staff #3 had a sex offender name check that was completed 7 days after the start of employment.

At the time, the center did not have the results of Staff #1's out of state child abuse and neglect background check. Staff #6, employed for over one month, had an out of state child abuse and neglect background check that was requested 13 days after the start of employment.

Evidence: 1. The records of child #3 (date of enrollment: 6/3/2024) and child #5 (date of enrollment 6/3/2024) were missing one emergency contact address. Child records are required to contain the name, address, and phone number of two designated people to call in an emergency if a parent cannot be reached. 2. Administration acknowledged the records were incomplete.

Evidence: 1. Chipped and peeling paint was observed in classroom #1 in areas accessible to the children. On the infant/toddler playground, chipped paint and splintered wood was observed on the front of the shed. 2. Administration acknowledged that the areas required maintenance.
