22VAC40-185-40-E · Based on interviews with staff and review of the center's supervision procedures and playground safety procedures, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: the center's Interactions with Children policy states, "Supervise children at all times" and the Playground Safety policy states, "The Center's staff shall ensure supervision of children on all playgrounds to provide a safe outdoor play environment." On April 7, 2021, Child 1 (age 2 years) crawled through a hole in the fence and was out of supervision of the staff present for an undetermined length of time. There were two staff present on the playground at the time of the incident.

Areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. On the playground, the plastic panel of the gate was broken in a circular shape with rough edges, large enough for a child to place their hand through. In the infant room, the floors of the restroom had an accumulation of dirt along the borders and buildup around the toilet, and the diaper changing pad in the restroom had a film of dirt within the crevices. In the two vans used for transporation, there were three car seats being used with various spots and dirt covering the seats.

Evidence: 1. In the four-year-old classroom, the children?s sofa was ripped, exposing the foam filling, across the seat cushion. 2. In the three-year-old classroom, there was chipping paint and two holes in the wall, accessible to children on both sides of the classroom. Around the door frame, a broken piece of the wooden panel was exposed and within reach of the children. A broken electrical socket plate was also identified in the classroom, resulting in plastic rough edges and exposure to wall plaster. 3. On the playground, the plastic panel of the gate was broken in a circular shape with rough edges, large enough for a child to place their hand through.

1. The toilet paper holder in the two year old bathroom was broken and the toilet paper was on the floor. 2. The base molding was loose from the wall in the girls bathroom, exposing crumbled drywall accessible to children. 3. A large tree root was exposed at the base of the slide in the fall zone.
