22.1-289.036-B-4 · Based on review of five staff records, observations and interview, the center did not obtain a sex offender registry check and satisfactory results of the child abuse and neglect registry from a state in which one staff member resided in the preceding five years.
Evidence: 1. The record for Staff #4 (hire date 12/06/2020) indicated the staff member resided in another state within the last five years. Results of a sex offender registry check and satisfactory results of the child abuse and neglect registry from the other state had not been obtained for Staff #4. 2. The staff was observed working with children in the center during the 12/07/2021 inspection. 3. A member of management confirmed this information had not been received as of 01/24/2022.

Systemic Deficiency The center is required to establish and implement procedures to ensure appropriate supervision of all children in care, including daily intake and dismissal procedures to ensure safety of children. 1. On 04/28/2026, a vape device containing marijuana was found on the rug in classroom #1, which serves children ages 12-18 months. Staff #2 observed an 18-month-old child preparing to pick up the device and immediately intervened. Staff #1 acknowledged ownership of the vape and stated that it had fallen out of their pocket while exiting the classroom. Staff #1 also confirmed that the vape contained marijuana. 2. The center's written policy titled "Substance Abuse Control" states "The manufacture, distribution, possession, use, or sale of illegal substances, or any unauthorized drugs and drug paraphernalia, on center premises, vehicles, or during off-site activities is strictly prohibited.

Video footage (dated 04/07/26) shows staff #1 placing child #1, age 19 months, onto the changing table. Staff #1 does not keep a hand on the child. Staff #1 turns to close the gate to the the diaper changing area, and child #1 falls from the changing table to the bare floor. Child #1 immediately begins crying.

Staff #1, employed for 2 weeks, did not have documentation of certification from a physician or physician assistant to be free from any disability which would prevent them from caring for children under their supervision.

The center shall establish and implement procedures for appropriate supervision of all children in care. 1. Staff #1 and staff #2 transitioned classroom #1, with 12 children age 2 years, from the classroom located on the "middle" floor via the elevator down to the basement level to go to the fellowship hall. 2. Child #1, age 2 years, was found on the elevator by staff #3 when the elevator returned to the middle floor which is 2 floors above the basement floor. Child #1 was crouched in the corner of the elevator, shaking, screaming and crying. 3. Staff #3 picked up child #1 to comfort the child. Staff #3 took child #1 back to her classroom and reported the incident to administration. 4. Administration reported that when staff #1 and staff #2 were confronted they did not realize that child #1 was missing from the group. Staff #1 and staff #2 stated that they did not conduct the required face to name tracking procedure when they transitioned the class from the elevator to the fellowship hall. 5. Child #1 was out of supervision and alone for approximately 5 minutes.
