8VAC20-780-350-B-1 · Based on observation and interview, the facility failed to maintain staff-to-children ratios as
specified. Evidence: On 09/19/2022 during the classroom observations with the Program Director and Licensing Inspector, the Licensing Inspector observed 17 children and 4 staff in the toddler classroom. It was determined that the youngest child in the room at the time was 14 months which requires a 1:4 staff-to-child ratio based on the youngest child in the group. Evidence: On 09/19/2022 during the classroom observations with the Program Director and Licensing Inspector, the Licensing Inspector observed 21 children and 3 staff in the Beginner Room(two year old room). The classroom was 5 children over ratio. The required ratio based on the age of the youngest child who was not yet 2 is 1:5.

Evidence: The staff record contained no documentation of Out of State Child Abuse and Neglect results from Texas for Staff #4. Staff #4 began employment on 8/14/23. The sworn statement dated 8/14/23 documented that Staff #4 had resided in Texas within the last 5 years. There was documentation in the record that a request to search was submitted on 8/22/23. In an exit interview on 4/19/24, CR #1 acknowledged that no results were received and that no follow up was completed after the initial request.

Evidence: On September 26, 2023, S1 roughly handled two children. S1 used her hand on a child?s forehead to redirect him. She moved another child by his arm to redirect him to a carpeted area; when the child did not follow her directions, she picked him up under his arms and sat him forcefully on the classroom stairs.

by staff. Evidence: The licensing office received an anonymous complaint reporting a staff member was handling a child in a rough manner and restricting the child?s movement on 09/27/2022. The Licensing Inspector interviewed facility staff including the teacher and reviewed records including a summary completed by facility leadership on 10/04/2022. Records documented the staff member ??forcefully sit the child down on the ground and place her legs on either side of him keeping him from getting up. When he would try to get up, she would make him sit back down.? Facility Leadership sent her home for the day based on their observations in the classroom, their review of video tape, and supervisory meeting. Licensing Inspector received notification the teacher was no longer with the center effective 10/07/2022.
