8VAC20-780-40-E · The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures.

The center's own policies for identifying where attending children are at all times, including procedures to ensure that all children are accounted for was not followed on September 11 2025. The center's policy states that ?Regular and accurate name-to-face headcounts must be completed by staff at every threshold.? Staff #1 did not complete a name to face check at the threshold entrance of the playground, on September 11 2025. Child #1 (age 4 years) and Child #2 (age 4 years) were left on the playground while Staff #1 brought the remainder of the children indoors. Staff #2 located Child #1 and Child #2 approximately 10 minutes after the group returned inside.

On February 25 2026, Child #1 (age 5 years) was not within sight and sound supervision for approximately 4 minutes. Center staff was observed leading a group of children to the school bus area at 8:44:50am. At 8:45:59am Child #1 entered the breezeway of the center. Child #1 could be seen attempting to follow where the group exited, but could not manage the gate. Child #1 was located by a parent at 8:49:15am and was brought to the front lobby of the center.

A classroom within the center had a displayed temperature under 68 degrees Fahrenheit. The temperature was observed at 62.6 degrees Fahrenheit for approximately 15 minutes.

8VAC20-780-160-A · Each staff member shall submit documentation of a negative tuberculosis screening.

The documentation shall have been completed within the last 30 calendar days of the date of employment and be signed by a physician, physician's designee, or an official of the local health department. Staff 3 record contained documentation of a Tuberculosis screening but was dated 14 months prior to the employees start date. The center is approximately 2 months out of compliance.

8VAC20-780-340-F · Based on interviews, the center did not ensure that all children under the age of 10 years shall always be within sight and sound supervision of staff.

Evidence: On April 17, 2024 a child (Child #1) was reported to having been left alone in his section of the classroom. It was determined that no other teachers in the other parts of that large room were aware that the child was left unattended. The supervising teacher failed to do a proper name to face check of each child in their care, prior to going outside. Child #1 was left unattended for approximately 3 minutes. There were other teachers near by to hear if Child #1 was in distress, but they were unaware that Child #1 was left in the classroom. Child #1 was located upon another teacher walking through the space heard the child in the room.

22.1-289.035-B-4 · Based on record review, the center did not ensure that all employees that have lived outside of the state of Virginia within the last five(5) years has a child abuse and neglect search for the state they previously resided in within 30 days of first day of employment.

Evidence: Staff #1 was hired May 2023 and did not have an out of state search on record for the state the employee identified living in within the last 5 years.
